HomeMy WebLinkAboutG22-93 Ordinance No. G22-93 AN ORDINANCE RECLASSIFYING PROPERTY LOCATED AT 50 NORTH McLEAN BOULEVARD WHEREAS, written application has been made to reclassify certain property located at 50 N. McLean Boulevard, commonly known as the Taylor YMCA, from CF Community Facility District to PCF Planned Community Facility District; and WHEREAS, the Planning and Development Commission has conducted a public hearing after due notice and submitted its written findings and recommendations to the City Council; and WHEREAS, the City Council has reviewed the recommendations of the Planning and Development Commission and concurs in such recommendations . NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1 . That Chapter 19 . 07, Section 19 . 07 . 600 entitled "Zoning District Map" of the Elgin Municipal Code, 1976, as amended, be and the same is hereby further amended by adding thereto the following paragraph: emik "The boundaries hereinafter laid out in the ' Zoning District Map' , as amended, be and are hereby altered by excluding from the CF Community Facility District and including in the PCF Planned Community Facility District, the following described property: OF THAT PART OF THE EAST HALF OF THE WEST HALF OF SECTION 15, TOWNSHIP 41 NORTH, RANGE 8 EAST OF THE THIRD PRINCIPAL MERIDIAN, DESCRIBED AS FOLLOWS: COMMENCING AT A POINT ON THE NORTH-SOUTH CENTER LINE OF SAID SECTION 15, ACCORDING TO KA-WA-EE GARDENS AND MAPLE MANOR UNIT NO. 1, BOTH BEING SUBDIVISIONS OF PART OF SAID SECTION 15, THAT IS 214 .50 FEET NORTHERLY OF THE NORTHERLY LINE OF LARKIN AVENUE, ACCORDING TO SAID KA-WA-EE GARDENS; THENCE WESTERLY, ALONG THE NORTH LINE, AS MONUMENTED, OF SAID KA-WA-EE GARDENS AND THE EASTERLY AND WESTERLY EXTENSION THEREOF HAVING AN ANGLE OF 89 DEGREES 52 MINUTES 47 SECONDS (RECORD BEING 90 DEGREES 00 MINUTES 00 SECONDS) , AS MEASURED FROM SOUTH TO WEST, FROM THE SAID NORTH-SOUTH CENTER LINE OF SECTION 15, A DISTANCE OF 660. 00 FEET TO A LINE THAT IS 660.00 FEET, AS MEASURED PERPENDICULAR, WEST OF AND PARALLEL WITH THE SAID NORTH-SOUTH CENTER LINE OF SECTION 15; THENCE NORTHERLY, ALONG SAID PARALLEL LINE, A DISTANCE OF 21 .41 FEET FOR THE POINT OF BEGINNING; THENCE WESTERLY, A DISTANCE OF 165 . 94 FEET TO A POINT ON THE EASTERLY LINE OF MAPLE MANOR UNIT NO. 5, BEING A SUBDIVISION OF PART OF SECTION 15, TOWNSHIP AND RANGE AFORESAID, THAT IS 314 .48 FEET, AS MEASURED ALONG THE SAID EASTERLY LINE AND THE NORTHERLY EXTENSION THEREOF, SOUTHERLY OF THE INTERSECTION OF SAID EASTERLY LINE AND THE NORTHERLY EXTENSION THEREOF WITH THE WESTERLY EXTENSION OF THE SOUTH LINE OF LOT 25 OF MAPLE MANOR UNIT NO. 4 , BEING A SUBDIVISION OF PART OF SECTION 15, TOWNSHIP AND RANGE AFORESAID, SAID INTERSECTION POINT BEING A JOG IN THE SOUTH LINE OF LOT 26 OF SAID MAPLE MANOR UNIT NO. 4; THENCE NORTHERLY, ALONG SAID EASTERLY LINE AND THE NORTHERLY EXTENSION THEREOF, A DISTANCE OF 314 .48 FEET TO THE SAID INTERSECTION POINT BEING A JOG IN LOT 26; THENCE EASTERLY, ALONG A SOUTH LINE OF LOT 26 AND ALONG THE SOUTH LINE OF LOTS 25 AND 24 OF SAID MAPLE MANOR UNIT NO. 4, A DISTANCE OF 165 . 68 FEET TO A POINT ON A LINE THAT 660 . 00 FEET, AS MEASURED PERPENDICULAR, WEST OF AND PARALLEL WITH THE AFORESAID NORTH-SOUTH CENTER LINE OF SECTION 15; THENCE SOUTHERLY, ALONG SAID PARALLEL LINE, A DISTANCE OF 314 . 33 FEET TO THE POINT OF BEGINNING. BEING SITUATED IN THE CITY OF ELGIN, KANE COUNTY, ILLINOIS. " Section 2 . PURPOSE AND INTENT: The purpose of this PCF (Community Facility District is to provide recreational, health, and social services to the community. Section 3 . SUPPLEMENTARY REGULATIONS: Except as may be noted herein, any word or phrase contained within this chapter followed by the symbol " [SR] " shall be subject to the definitions and the additional interpretive requirements provided in Chapter 19 . 90, Supplementary Regulations . The exclusion of such symbol shall not exempt such word or phrase from the applicable supplementary regulation. Section 4 . GENERAL PROVISIONS: Except as may be noted herein, the use and development of land and structures in this PCF District shall be subject to the general regulations contained in Chapter 19 . 05, General Provisions . Section 5 . ZONING DISTRICTS GENERALLY: Except as may be noted herein, the use and development of land and structures in this PCF District shall be subject to the provisions of Chapter 19 . 07, Zoning Districts . Section 6 . LOCATION AND SIZE OF DISTRICT: The location and size of this PCF District shall be inclusive of all of the territory legally described in Section 1 of this ordinance. Section 7 . LAND USE: The use of the land and structures within this PCF District shall be as depicted on the fieldhouse Addition-Floor Plan/Site Plan, prepared by Burnidge Cassell and Associates, dated June 5, 1992 . In addition, the following enumerated land uses may be permitted, subject to the review and approval of the Development Administrator: MISCELLANEOUS USES DIVISION --Refuse Collection Area (SR) --Signs (SR) (UNCL) subject to Chapter 19 .50, Signs --Temporary Uses (SR) (UNCL) encompassing special events such as carnivals, Christmas tree sales, and festivals --Accessory Structures (SR) (UNCL) subject to Section 19 . 12 .500 --Accessory Uses (SR) (UNCL) subject to Section 19 . 10 .400 Section 8 . SITE DESIGN/BUILDING ELEVATIONS: The development of the land and structures within this PCF District shall be as depicted on the Fieldhouse Addition-Floor Plan/Site Plan, dated June 5, 1992 and the Building Perspective, dated June 5, 1992 . Both plans prepared by Burnidge Cassell and Associates . Section 9 . OFF-STREET PARKING: The development of the off-street parking lot in this PCF District shall be as depicted on the Fieldhouse Addition-Floor Plan/Site Plan, prepared by Burnidge Cassell and Associates, dated June 5, 1992 . Section 10 . SIGNS: Signs in this PCF District shall be subject to the provisions of Chapter 19 .50, Signs . Section 11 . VARIATIONS: No variations shall be permitted. Changes to the development plan shall be reviewed pursuant to Chapter 19 .60 .200, Changes to Planned Developments . Section 12 . APPEALS: Any requirement, determination, or interpretation associated with the administration and enforcement of this ordinance may be appealed subject to the provisions of Chapter 19 .75, Appeals . Section 13 . SITE AND OWNERSHIP REQUIREMENTS: The site of this PCF District shall remain under single ownership or unified control (SR) . Section 14 . CHANGES TO THE PLANNED DEVELOPMENT: Changes to the development plan shall be reviewed pursuant to the provisions of Section 19 . 60 .200, Changes to Planned Developments . Section 15 . REVOCATION OF THE PLANNED DEVELOPMENT: Revocation of this PCF District shall be subject to the provisions of Section 19 . 60 .210, Revocation of Planned Developments Section 16 .
