HomeMy WebLinkAboutG78-91 (Pik Ordinance No. G78-91 AN ORDINANCE AMENDING CERTAIN DEVELOPMENT REGULATIONS OF THE ELGIN MUNICIPAL CODE, 1976, AS AMENDED BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1 . That Section 14 . 08 . 020 of Chapter 14 . 08 entitled "Sewer System" of the Elgin Municipal Code, 1976, as amended, be and is hereby amended to read as follows : 14 . 08 . 020 Storm and sanitary sewer--Cross connection prohibited. It is unlawful for any person, firm or corporation to connect, cause to be connected, assist or take part in connecting any storm sewer with any sanitary sewer, or any part thereof, or any sanitary sewer with any storm sewer or any part thereof. All downspouts, outside stairwells and roof drains shall discharge onto the ground or be eft. connected to storm sewers, drainage ditches or storm drainage systems . Footing drains shall be connected to sump pumps and discharge shall be made into storm sewers or sewer lines connected to storm sewers . Where developments are approved without a storm sewer, sump pumps shall discharge into drainage ditches or storm drainage systems . Sump pumps installed to receive and discharge building floor drain flow, laundry tubs or other wastewater shall be connected to the sanitary sewers . Each individual sump pump shall be used for one function only, either the discharge of uncontaminated storm related groundwaters or the discharge of wastewater. It is unlawful for any person, firm or corporation to connect, or cause to be connected any drain carrying, or to carry, any toilet, sink, basement, septic tank, cesspool, or industrial waste or any fixture or device discharging polluting substances to any storm water drain in the city. Section 2 . That Section 18 . 08 . 050 of Chapter 18 .08 entitled "Definitions" of the Elgin Municipal Code, 1976, as amended, be and is hereby amended to read as follows: 18 . 08 . 050 Density, net residential . "Net residential density" means the ratio between the total number of dwelling units by dwelling unit type on the land area designated for that type of residential use and the total residential land area by dwelling unit type in acres, exclusive of all public and private right-of-way and other nonresidential uses . Section 3 . That Section 18 . 08 .225 of Chapter 18 . 08 entitled "Definitions" of the Elgin Municipal Code, 1976, as amended, be and is hereby added to read as follows : 18 . 08 .225 Sanitary wastewater treatment facility, public. "Sanitary wastewater treatment facility, public" means a facility owned and operated by the Fox River Water Reclamation District or the Metropolitan Water Reclamation District of Greater Chicago and designed for the treatment of sanitary wastewater effluent. Section 4 . That Section 18 . 16 . 010(E) of Chapter 18. 16 entitled "Preliminary Plat" of the Elgin Municipal Code, 1976, as amended, be and is hereby amended to read as follows : E. Northpoint. emb- Section 5 . That Section 18 . 16 . 020(G) of Chapter 18. 16 entitled "Preliminary Plat" of the Elgin Municipal Code, 1976, as amended, be and is hereby amended to read as follows : G. Topographic data including existing contours at vertical intervals of not more than two feet (topographic data refers to the city datum) ; watercourses, floodplains, wetlands, rock outcrops, trees of twelve inch diameter or more, other significant features, and soil bearing data at locations and depths as may be required by the engineering division of the department of public works . Section 6 . That Section 18. 16 . 030(H) of Chapter 18 . 16 entitled "Preliminary Plat" of the Elgin Municipal Code, 1976, as amended, be and is hereby amended to read as follows : H. Impact assessments as may be required by the planning department in order to adequately evaluate the effect of the proposed development on the environment and existing community facilities and surrounding land uses, existing and proposed. A wetlands assessment report may be required. A r traffic impact analysis may be required by the engineering division of the department of public works and shall contain components as described in the Institute of Traffic Engineers publication, Transportation and Land Development. Section 7 . That Section 18 .20 .010 of Chapter 18.20 entitled "Final Plat" of the Elgin Municipal Code, 1976, as amended, be and is hereby amended to read as follows : 18 .20 . 020 Identification and description. The final plat shall be accurately drawn in ink on material capable of producing clear and legible contact prints or photostatic copies and shall show the following: A. Name and address of developer; B. Street names; C. Location by section, township, and range and by legal description; D. Graphic (engineering) scale shall be one inch to one hundred feet. An additional plat at an alternative scale may be submitted for recording purposes if required for plat legibility and eft. approved by the planning department and the engineering division of the department of public works; E. Northpoint. Section 8 . That Section 18 .28 . 020(A) of Chapter 18 .28 entitled "Required Improvements" of the Elgin Municipal Code, 1976, as amended, be and is hereby amended to read as follows : A. Sanitary sewer lines, including sewer stub terminals at the property line of each lot or each potential building location, shall be installed to serve all properties except where private septic systems are permitted. Sanitary sewer lines shall be connected to a public sanitary sewage collection system which shall be connected to a public sanitary wastewater treatment facility. Section 9 . That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. Section 10 .
