HomeMy WebLinkAboutG55-91 tek Ordinance No. G55-91 AN ORDINANCE GRANTING A SPECIAL USE FOR OFF-STREET PARKING ( 315 North Weston Avenue) WHEREAS, written application has been made for a special use for the establishment, maintenance and operation of an off-street parking lot at 315 North Weston Avenue; and WHEREAS, the Land Use Committee conducted a public hearing after due notice by publication and has submitted its findings of fact and recommended approval; and WHEREAS, the City Council of the City of Elgin concurs in the findings and recommendation of the Land Use Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1 . That the City Council of the City of Elgin hereby adopts the findings of fact made by the Elgin Land Use Committee, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. eft Section 2 . That a special use for off-street parking at 315 North Weston Avenue, Elgin, Illinois, legally described as follows : Lot 10 and the South 24 feet of Lot 11 in Block 7 of Highland Avenue Addition to Elgin, in the City of Elgin, Kane County, Illinois . be and is hereby granted subject to the following conditions : 1 . Conformance with the site plan prepared by Metron Engineering Co. and dated February 28, 1991, revised June 26, 1991 and July 11, 1991 . 2 . Compliance with all other applicable codes and ordinances . Section 3 . That the special use granted herein shall expire if not established within one year from the date of passage of this ordinance. Section 4 . SUBJECT Consideration of Petition 36-91 Requesting a R-2 Single Family Residence District Special Use for Off-street Parking, Property Located at 315 North Weston Avenue by John and Stella Paul, as Applicants and Owners. II. CONSIDERATIONS A petition has been filed by John and Stella Paul requesting a R-2 Single Family Residence District special use for off-street parking. The subject property is located at 315 North Weston Avenue. The petitioner proposes to develop the subject property with a 26 space parking lot. The parking lot would serve a restaurant under construction at 1300 _Lawrence Avenue. III. FINDINGS After due notice, as required by law, the Land Use Committee held a public hearing on Petition 36-91 on June 17, 1991 . The petitioner testified at the public hearing and presented documentary evidence. Objectors appeared at the hearing and written objection has been filed. The Land Use Committee has made the following findings with respect to Petition 36-91 : A. Site Characteristics: The subject property is a regularly shaped parcel containing approximately 9,500 square feet. The subject property is relatively flat, and is unimproved. B. Sewer and Water: The subject property would not be serviced by sanitary sewer or water, if developed as proposed. Storm water must be controlled, pursuant to Chapter 18.36 - Stormwater Control, of the Elgin Municipal Code. C. Traffic and Parking: Traffic counts are unavailable for Weston Avenue. Trip generation data is unavailable for parking lots. A minimum of 41 off-street parking spaces are required for the proposed 2,414 square foot restaurant. The -Page 1 - Exhibit A . petitioner is proposing to provide 41 off-street parking spaces at the restaurant property, and an additional 26 spaces at the subject property. D. Zoning History: 1927 Out 1960 A-Res. 1962 R-2 1950 Out 1961 A-Res. Present R-2 E. Zoning Status: The subject property is unimproved. However, the subject property could be developed in accordance with the zoning and subdivision ordinance standards. F. Surrounding Land Use and Zoning: The area located to . the north of the subject property is zoned R-2 and is developed with a residence and Kimball Middle School. The areas located to the south and east of the subject property are zoned R-2 and are developed with residences. The area located to the west of the subject property is zoned B-1 and is developed with restaurant uses. G. Trend of Development: The subject property is located within an area which has developed with residential and commercial uses. H. Comprehensive Plan: The subject property is designated as urban residential in the Comprehensive Plan. I. Special Use Standards: The Land Use Committee is of the opinion that the proposed special use is in substantial conformance with the special use standards. J. Conditions for Approval: The Land Use Committee is of the opinion that approval of Petition 36-91 should be subject to the following conditions: 1. Revisions to the site plan, prepared by Metron Engineering, dated February 28, 1991, per the Bureau of Inspection Services, the Engineering Division, and the Planning Department. 2. Substantial conformance with the revised site plan. 3. Compliance with all applicable codes and ordinances. r -Page 2 - fek IV. RECOMMENDATION On a motion to recommend approval of Petition 36-91, subject to the conditions for approval the vote was five (5) yes and zero (0) no. Therefore, the motion to recommend approval of Petition 36-91 was adopted. P Robert W.
