AN ORDINANCE
GRANTING A SPECIAL USE FOR A DAY CARE CENTER
AT 51 SOUTH SPRING STREET
WHEREAS, written application has been made for a special
use for the establishment, maintenance and operation of a day
care center at 51 South Spring Street; and
WHEREAS, the Land Use Committee conducted a public
hearing after due notice by publication and has submitted its
findings of fact and recommended approval; and
WHEREAS, the City Council of the City of Elgin concurs in
the findings and recommendation of the Land Use Committee.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1 . That the City Council of the City of Elgin
hereby adopts the findings of fact made by the Elgin Land Use
Committee, a copy of which is attached hereto and made a part
hereof by reference as Exhibit A.
r Section 2 . That a special use for a day care center at
51 South Spring Street, Elgin, Illinois, legally described as
follows :
Lots 7, 8, 9, and 10 and that part of Lots 5,
6, 11 and 12 lying southwesterly of the
southwesterly right-of-way line of the Chicago and
Northwestern Railway Company, all in Block 12 of the
original town of Elgin, on the East side of Fox
River, in the City of Elgin, Kane County, Illinois,
including all improvements and structures thereon,
and all of Lot 5, and the easterly 15 . 74 feet of
Lot 12 , and that part of Lots 3, 4, 13, 14 and 16
which lie southwesterly of the southwesterly
right-of-way line of the Chicago and Northwestern
Railway Company, all in Block 13 of J.T. Gifford' s
plat of Elgin, in the City of Elgin, Kane County,
Illinois .
be and is hereby granted subject to the following conditions :
1 . Substantial conformance to the parking and
building plan prepared by Burnidge, Cassell and
Associates, dated June 27, 1991 .
2 . Substantial conformance with the
petitioner's statement.
! 3 . Compliance with all other applicable codes
and ordinances.
Section 3 . That the special use granted herein shall
expire if not established within one year from the date of
passage of this ordinance.
Section 4 . That this ordinance shall be in full force
and effect after its passage in the manner provided by law.

LAND USE COMMITTEE
PLANNING AND LAND USE COMMISSION
CITY OF ELGIN
I. SUBJECT
Consideration of Petition 44-91 Requesting a B-2 Central
Business District Special Use for a Day Care Center,
Property Located at 51 South Spring Street, by Elgin Day
Care Center, as Applicant and Elgin Community College, as
Owner.
II. CONSIDERATIONS
An application has been filed by the Elgin Day Care Center
requesting a Special Use for a Day Care Center. The
subject property is located on the Elgin Community College
Fountain Square Campus located at 51 South Spring Street.
Currently Elgin Community College operates a day care
'" program at 51 South Spring Street for approximately 20
children. Elgin Day Care proposes to relocate from its
existing facility at 370 East Chicago Street to 51 South
Spring Street. Upon relocation, it is estimated that a
total of 80 children could be provided day care services
at the proposed location.
III. FINDINGS
After due notice, as required by law, the Land Use
Committee held a public hearing on Petition 44-81 on July
1, 1991 . The petitioner testified at the public hearing
and presented documentary evidence. No objectors appeared
at the hearing and no written objection has been filed.
The Land Use Committee has made the following findings
with respect to Petition 44-91 :
A. Site Characteristics: The subject property is an
irregularly shaped:. parcel containing approximately
52,280 square feet. The subject property is improved
with a masonry building (Elgin Community College
Fountain Square Campus) and an off-street parking
facility providing 35 parking spaces.

B. Sewer and Water: The subject property is served by a
combination sewer system and municipal water. The
proposed special use would not affect current service
capacity.
C. Traffic and Parking: The subject property is bounded
by DuPage Street on the north, Spring Street on the
west and Fulton Street on the south. Spring Street
carries approximately 5,500 vehicles per day (1990
count) . There are no available data regarding traffic
generation of day care centers or pre-schools.
However, additional traffic generation would occur
based upon the additional, estimated number of
children (60) to be served (20 children are currently
served at the subject property) . •
Currently, 35 off-street parking spaces are available
on the subject property. Four parking spaces would be
removed to provide the outdoor exercise area required
for state certification of the day care center. The
subject property is located in the B-2 Central
Business District. Uses located in the B-2 Central
Business District are not required to provide on-site
off-street parking pursuant to E.M.C. Chapter
19.44.100 (C) . , Off-street Parking.

E. Zoning Status: The subject property is improved with
a lawful building and off-street parking facility.
F. Surrounding Land Use and Zoning: The areas located
to the north of the subject property is zoned B-2
Central Business District and is developed with
commercial buildings.
The areas located to the east of the subject property
are zoned B-2 Central Business District and B-3
Service Business District and is improved with a
railroad line, an off-street parking lot, the Elgin
Senior Center and commercial buildings.
The area located west of the subject property is zoned
B-2 Central Business District and is improved with
various commercial buildings.

G. Trend of Development: The subject property is
located within the Central Business District. The
area is developed with a mix of retail, commercial
service and office uses.
H. Comprehensive Plan: The subject property is
designated as part of the Downtown Commercial Center
in the Comprehensive Plan.
I. Special Use Standards: The Land Use Committee is of
the opinion that Petition 44-91 is in substantial
conformance with the special use standards.
J. Conditions for Approval: The Land Use Committee is of
the opinion that approval of Petition 44-91 should be
• subject to the following conditions:
1. Substantial conformance to the parking and
building plan prepared by Burnidge, Cassell and
Associates, dated June 27, 1991.
2. Substantial conformance with the Petitioner's
Statement.
e 3. Compliance with all other applicable codes and
ordinances.
IV. RECOMMENDATION
On a motion to recommend approval of Petition 44-91,
subject to the conditions for approval, the vote was four
(4) yes and zero (0) no.
Therefore, the motion to recommend approval of Petition
44-91 was adopted.
