AN ORDINANCE
RECLASSIFYING PROPERTY AT 417 WEST HIGHLAND AVENUE
WHEREAS, written application has been made to reclassify
certain property located at 417 West Highland Avenue from B-3
Service Business District to R-4 General Residence District;
and
WHEREAS, the Land Use Committee has conducted a public
hearing after due notice and submitted its written findings
and recommendations to the City Council; and
WHEREAS, the City Council has reviewed the
recommendations of the Land Use Committee and concurs in such
recommendations .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE (.
CITY OF ELGIN, ILLINOIS:
Section 1 . That Chapter 19 . 08, Section 19 .08 . 020 f
entitled "Zoning District Map" of the Elgin Municipal Code,
1976, as amended, be and the same is hereby further amended by
adding thereto the following paragraph:
"The boundaries hereinafter laid out in the
'Zoning District Map' , as amended, be and are hereby
altered by excluding from the B-3 Service Business
District and including in the R-4 General Residence
District, the following described property:
That part of Lots 1 and 2 in Block 45 of the
original town (now city) of Elgin, in Kane County,
Illinois, on the west side of Fox River as laid out
by William C. Kimball, bounded and described by
commencing at the Northeast corner of said Lot 1;
thence southeasterly along the East side of said
Lots 1 and 2 to the Southeast corner of said Lot 2;
thence southwesterly along the South line of said
Lot 2, 66 feet; thence northwesterly parallel with
the easterly line of said Lots 1 and 2 to the
northerly line of said Lot 1; thence East along the
northerly line of said Lot 1 to the place of
beginning; subject to and including an easement over
a strip of land 4 feet wide off from the easterly
side of the above described premises to be used as a
driveway in common with a strip of land 4 feet wide
off the westerly side of Lot 15 in said Block 45;
and also an easement over a strip of land 8 feet
wide across the southerly side of said Lot 15 is
also used as a driveway, all for the joint use and
benefit of the owners and occupants of said Lot 15
and the premises above described, and that said
easements for driveway purposes shall be construed
as a covenant running with the land. Also, Lot 3
(except the westerly 66 feet of even width) in Block
45 of the original town of Elgin, on the West side
of Fox River, in the City of Elgin, Kane County,
Illinois, as per plat thereof by William C. Kimball
now on record in the Recorder's Office of said Kane
County, all in the City of Elgin, Kane County,
Illinois . "
Section 2 . That this ordinance shall be in full force
and effect from and after its passage and approval in the
manner provided by law and shall be published in pamphlet form
by authority of the City Council .
