HomeMy WebLinkAboutG29-91 Ordinance No. G29-91 rm" AN ORDINANCE RECLASSIFYING PROPERTY AT 1520 BIG TIMBER ROAD AND GRANTING A SPECIAL USE FOR AN AUTOMOBILE LAUNDRY WHEREAS, written application has been made to reclassify certain property located at 1520 Big Timber Road from B-3 Service Business District to B-4 General Service District and for a special use for an automobile laundry; and WHEREAS, after due notice in the manner provided by law the Land Use Committee conducted a public hearing concerning said application and has submitted its written findings and recommendation that the subject property be reclassified and a special use for an automobile laundry be granted; and WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings and recommendation of the Land Use Committee and concurs in its recommendation. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Chapter 19 .08, Section 19 . 08. 020 entitled "Zoning District Map" of the Elgin Municipal Code, 1976, as amended, be and the same is hereby further amended by adding thereto the following paragraph: "The boundaries hereinbefore laid out in the 'Zoning District Map' , as amended, be and are hereby altered by excluding from the B-3 Service Business District and including in the B-4 General Service District the following described property: That part of Fractional Section 3, Township 41 North, Range 8 East of the Third Principal Meridian, described as follows: Beginning at the intersection of the North line of Big Timber Road with the East line of Sleepy Hollow Road; thence northerly along the East line of Sleepy Hollow Road, a distance of 150.0 feet; thence easterly parallel with the North line of Big Timber Road, a distance of 150. 0 feet thence southerly parallel with the East line of Sleepy Hollow Road, a distance of 150 . 0 feet to the North line of Big Timber Road; thence westerly along said North line, a distance of 150 .0 feet to the place of beginning. Being situated in the City of Elgin, Kane County, Illinois. " Section 2 . That the City Council of the City of Elgin hereby adopts the findings of fact made by the Land Use 4 Committee granting a special use for an automobile laundry, a copy of which is attached hereto as Exhibit A and incorporated herein by reference, subject to the following conditions : 1 . Compliance with the site plan prepared by Amoco Oil Company dated March 13, 1991 . 2 . Ten continuous stacking spaces for the automatic wash bay. 3 . Compliance with all other applicable codes and ordinances . Section 3. That the special use granted herein shall expire if not established within one year from the date of passage of this ordinance. Section 4 . SUBJECT Consideration of Petition 11- 91 Requesting a Rezoning from B-3 Service Business District to B-4 General Service District , with a Special Use for an Automobile Laundry, Property Located at 1520 Big Timber Road , by the Amoco Oil Company, as Applicant and Owner . II . CONSIDERATIONS A petition has been filed by the Amoco Oil Company requesting a rezoning from B-3 Service Business District to B-4 General Service District with a special use for an automobile laundry. The subject property is located at 1520 Big Timber Road . The petitioner desires to modify the existing automobile service station to include a convenience store and an automobile laundry with one automatic wash bay. The car wash is proposed to be open during the regular hours of operation of the service station. III . FINDINGS After due notice , as required by law , the Land Use Committee held a public hearing on Petition 11-91 on March 18 , 1991 . The petitioner testified at the public hearing and presented documentary evidence. No objectors appeared at the hearing , however , written objection has been filed . The Land Use Committee has made the following findings with respect to Petition 11- 91 : A. Site Characteristics : The subject property is a regularly shaped lot totalling 22 ,500 square feet ( 150 ' x 150 ' ) , or 0 . 51 acres . The subject property is zoned B- 3 Service Business District , and is currently developed with an automobile service station . Exhibit A • - 1- . • B. Sewer and Water : The subject property is serviced with feh* sanitary and storm sewers , and water lines , all of which have adequate capacity to accommodate the proposed uses . Source : Engineering Division , City of Elgin . C . Traffic and Parking : North McLean Boulevard and Big Timber Road function as and are designated as major arterials . North McLean Boulevard is scheduled to be widened from two to four lanes (north of Big Timber) in 1992 . Big Timber Road has been widened from two to four lanes from North mcLean Boulevard to route 31 . Big Timber Road from North McLean Boulevard to Randall Road is anticipated to be expanded to four lanes in 1994 . Current traffic counts are 27 ,300 ( 1990) for North McLean Boulevard and 19 ,480 ( 1990) for Big Timber Road . Automobile service stations generate approximately 133 daily vehicle trips per pump . Accordingly, the service station with 10 proposed pumping stations could generate 1 ,330 vehicle trips per day. Convenience stores generate approximately 322 vehicle trips per day for each 1 ,000 square feet of floor area . Accordingly, the proposed 930 square foot convenience store could eft generate approximately 300 vehicle trips per day. Automatic wash bays can accommodate approximately 10 vehicles per hour. Assuming the automobile laundry is open 15 hours a day, the use could generate 150 vehicle trips . It should be noted that a customer may make use of each of the proposed services during a single visit and that most of the customers are already using the street system for other purposes . The off-street parking ordinance does not contain provisions to regulate vehicle parking or stacking accessory to automobile laundries . The City of Elgin Land Use Committee has recommended that ten stacking spaces be required per automatic wash bay in a previous special use petition for an automatic car wash facility. The off-street parking requirement for a retail use is one space for each two hundred square feet of floor area . The proposed convenience store would contain approximately 930 square feet (excluding storage area and walk-in cooler) . Accordingly, five parking spaces would be required . Zoning History: The subject property was annexed to the City and zoned B- 3 in 1966 . E. Zoning Status : The subject property is improved with a lawful special use - an automobile service station. F. Surrounding Land Use and Zoning : The areas located to the north and east of the subject property are zoned B- 3 and are developed with various commercial uses . The area located directly to the west of the subject property is zoned B- 3 and is developed with an automobile service station and convenience store . The area located south of the subject property is zoned M- 1 and is developed with various industrial uses and the C.M. St . P. & P rail line . G. Trend of Development : The subject property is located within a developing area commercial center. H. Comprehensive Plan/Northwest Area Plan: The subject property is located in an area designated for commercial development . I . Suitability of Present Zoning : The Land Use Committee is of the opinion that in view of the surrounding land use and zoning , the trend of development in the area , and the goals , objectives and policies of the Comprehensive Plan , the current 8- 3 Service District zoning is unsuitable and the subject property should be rezoned to B-4 General Service District . J. Special Use Standards : The Land Use Committee is of the opinion that the proposed special use is in substantial conformance with the special use standards . R. Conditions for Approval : The Land Use Committee is of the opinion that approval of Petition 11-91 should be subject to the following conditions : 1 . Revisions to the site plan dated January 23 , 1991 per the Bureau of Inspection Services , the Engineering Division , and the Planning Department . 2 . Provide 10 continuous stacking spaces for the automatic wash bay. 3 . Compliance with all other applicable codes and ordinances . -3- . emk IV. RECOMMENDATION On a motion to recommend approval of Petition 11-91 , subject to the conditions for approval , the vote was six (6) yes and zero (0) no .
