AN ORDINANCE
AUTHORIZING THE ACQUISITION OF CERTAIN PROPERTY FOR PUBLIC PURPOSES
(Dundee Avenue Business District)
WHEREAS, the City of Elgin has heretofore approved a redevelopment project area
in the manner provided by Division 74.4 of Article 11 of Chapter 24 of the Illinois
Municipal Code; and
WHEREAS, real property located within said project area may be acquired for
purposes of the objectives of the redevelopment project or plan; and
WHEREAS, the acquisition of said property by purchase or eminent domain is
authorized; and
WHEREAS, the acquisition by eminent domain, if necessary, of certain real
property described below is hereby determined reasonably necessary to achieve the
objectives of the redevelopment plan and project.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section I. That it is hereby determined that it is necessary and desirable that the
City of Elgin shall acquire title to and possession of the following described real
e'' property, which property is necessary, required and needed for the purpose of achieving
the objectives of the redevelopment plan and project.
Parcel 12:
The South 45 feet of Lot 4 of Vim. H. Wilcox's Second Addition to
Elgin, in the City of Elgin, Kane County, Illinois. (Commonly known as
434 Dundee Avenue)
Parcel 16:
Lot 3 of Mrs. J.R. Kimball's Sub. Div. of Block 24 of P.J. Kimball Jrs'.
3rd Addition to Elgin, in the City of Elgin, Kane County, Illinois.
(Commonly known as 314 Seneca Street)
Parcel 17:
Lot 4 of Mrs. Jane R. Kimball's Sub. Div. of Block 24 of P.J. Kimball
Jrs'. 3rd Addition to Elgin, in the City of Elgin, Kane County, Illinois.
(Commonly known as 320 Seneca Street)
Parcel 18:
The East 58 feet of the West 190 feet of the North 2 chains of Lot 5
in Block 14 of P.J. Kimball's Jr. Third Addition to Elgin, in the City of

Parcel One: That part of Lot 5 in Block 14 of P.J. Kimball, Jr's. Third
Addition to Elgin, described as follows: Beginning at the North East corner
of said Lot 5; thence West along the North line thereof 15.5 feet; thence
South at right angles to the North line of said lot to the southeasterly line
of said Lot 5; thence Northeasterly along said Southeasterly line to the
point of beginning, in the City of Elgin, Kane County, Illinois.
Parcel Two: That part of Lots 7 and 8 of W.H. Wilcox's Second Addi-
tion to Elgin, described as follows: Beginning at a point in the North line of
Lot 8 aforesaid 87 feet and 7 inches West of the North East corner of Lot 7
aforesaid; thence southerly to the South East corner of said Lot 7; thence
westerly along the southerly line of Lots 7 and 8 to the South West corner
of said Lot 8; thence northerly along the westerly line of said Lot 8 to the
North West corner thereof; thence East along the North line of said lot to
the point of beginning, in the City of Elgin, Kane County, Illinois, (except
that part described as follows: That part of Lot 8 of said W.H. Wilcox's
Second Addition to Elgin, as per plat thereof on record in the recorder's
office of Kane County, Illinois, described by beginning at a point on the
westerly line of said Lot 8, which westerly line of said Lot 8 is also the
easterly line of Lot 5 in Block 14 of P.J. Kimball Jr's. Third Addition to
Elgin which point is the place where a line drawn at right angles to the
North line of said Lot 5 and 15.5 feet westerly, measured along the North
line of said Lot 5, from the North East corner of said Lot 5, intersects the
westerly line of said Lot 8; thence southerly on a course at right angles
with the North line of said Lot 5 to the southerly line of said Lot 8 of W.H.
Wilcox's Second Addition, thence northwesterly along the southerly line of
said Lot 8 to the South West corner thereof; thence northeasterly along the
westerly line of said Lot 8 to the point of beginning, in the City of Elgin,

said, 87 feet and 7 inches West of the North East corner of Lot 7, afore-
said; thence East along the North line of Lots 8 and 7 aforesaid, 61 feet;
thence South at right angles to said North line 64 feet; thence south-
westerly to the South East corner of said Lot 7; thence northerly to the
point of beginning, in the City of Elgin, Kane County, Illinois. (Commonly

Elgin, described as follows: Beginning at a point on the North line of said
Lot 7, 26 feet 7 inches West of the North East corner of said Lot 7; thence
South at right angles to the North line of said Lot 7, 64 feet; thence south-

Lot I I of Babbitt's Addition to Elgin, being a subdivision of Block 25
of P.J. Kimball Jr's. 3rd Addition to Elgin, in the City of Elgin, Kane
County, Illinois. (Commonly known as 367 Summit Street)
Parcel 27:
The West 33 feet and 9 inches of Lot 12 of Babbitt's Addition to
Elgin, in the City of Elgin, Kane County, Illinois. (Commonly known as
371 Summit Street)
Parcel 28:
Lot 12 (except the West 33.75 feet thereof) and the West 7.5 feet of
Lot 13, all in Babbitt's Addition to Elgin, in the City of Elgin, Kane County,
Illinois. (Commonly known as 373 Summit Street)
Parcel 29:
Lot 13, except the West 7Y2 feet, of Babbitt's Addition to Elgin, in the

Parcel 30:
Lot 7 in Babbitt's Addition to Elgin, being a subdivision of Block 25 of
P.J. Kimball's Jr. Third Addition to Elgin, in the City of Elgin, Kane

Section 2. That Larry L. Rice, City Manager of the City of Elgin, be and is
hereby authorized, empowered and directed to negotiate for and on behalf of the City of
Elgin with the owner or owners of the above described real property for the purchase by
the City of Elgin of the real property described in Section 1.
Section 3. That the City Manager be and is hereby authorized to offer the
following sums as and for compensation to the owner or owners of the above-described
property; said offer shall be in writing:

Section 4. In the event that the City Manager is unable to agree with the owner
or owners of said property as to compensation,#o be paid therefor, in accordance with the
provisions of this ordinance, then title to and possession of said property shall be
acquired by the City of Elgin in accordance with the laws of eminent domain of the State
of Illinois, and Wayne M. Jensen, Special Counsel, is hereby authorized, empowered and
directed to institute appropriate proceedings in any court of competent jurisdiction to
acquire title to and possession of said property for the City of Elgin in accordance with
the eminent domain laws of the State of Illinois.
