AN ORDINANCE
RECLASSIFYING PROPERTY WEST OF DOVER DRIVE BETWEEN
MAROON DRIVE AND VILLA STREET AND GRANTING A SPECIAL USE
FOR A PLANNED UNIT DEVELOPMENT
WHEREAS, written application has been made to reclassify
certain property located west of Dover Drive between Maroon
Drive and Villa Street from B-1 Community Business District to
R-3 Two Family Residence District and for a special use for a
residential planned unit development; and
WHEREAS, after due notice in the manner provided by law
the Land Use Committee conducted a public hearing concerning
said application and has submitted its written findings and
recommendation that the subject property be reclassified and a
special use for a residential planned unit development be
granted; and
WHEREAS, the City Council of the City of Elgin, Illinois,
has reviewed the findings and recommendation of the Land Use
Committee and concurs in its recommendation.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1 . That Chapter 19 .08, Section 19 . 08 .020
entitled "Zoning District Map" of the Elgin Municipal Code,
1976, as amended, be and the same is hereby further amended by
adding thereto the following paragraph:
"The boundaries hereinbefore laid out in the
'Zoning District Map' , as amended, be and are hereby
altered by excluding from B-1 Community Business
District and including in the R-3 Single Family
Residence District the following described property:
That part of Section 19, Township 41 North,
Range 9 East of the Third Principal Meridian,
described as follows: Beginning at the Northwest
corner of Lot 367 in Summerhill Unit 4, being a
subdivision of part of said Section 19, in the
township and range aforesaid, recorded 5-27-87 as
Document No. 87-284677; thence North 89 degrees 26
minutes 00 seconds West along the South line of
Maroon Drive as dedicated, 486 . 10 feet to the East
line of Lot 4 in County Clerk's Division of
Unsubdivided Lands, recorded June 20, 1895 as
Document No. 2237128; thence South 09 degrees 13
minutes 03 seconds West along said East line, 646 . 80
feet to the northerly right of way line of U.S .
Route 20 as per plat of dedication recorded
September 28, 1960 as Document No. 17976188; thence
South 56 degrees 46 minutes 53 seconds East along
said northerly line, 500 .00 feet to the Southwest
corner of said Summerhill Unit 4; thence North 33
degrees 13 minutes 07 seconds East along a westerly
line of said Unit 4, 527 .84 feet; thence North 56
degrees 46 minutes 53 seconds West along a southerly
line of said Unit 4 , 170 .00 feet to a point of
curvature in said southerly line; thence
northwesterly along a curve to the right, having a
radius of 60. 00 feet, an arc distance of 69 . 11 feet
to a point of tangency in the westerly line of said
Unit 4 ; thence North 09 degrees 13 minutes 03
seconds East along said westerly line, 317 . 14 feet
to the point of beginning, all in the City of Elgin,
Cook County, Illinois . "
Section 2 . That the City Council of the City of Elgin
hereby adopts the findings of fact made by the Land Use
Committee granting a special use for a residential planned
unit development, a copy of which is attached hereto as
Exhibit A and incorporated herein by reference, subject to the
following conditions:
1 . Compliance with the preliminary plat
prepared by the U.S. Shelter Group, Inc . dated
July 2, 1990 and revised September 4, 1990 .
2 . Compliance with all other applicable codes
and ordinances .
Section 3. That the special use granted herein shall
expire if not established within one year from the date of
passage of this ordinance.
Section 4 . That this ordinance shall be in full force
and effect from and after its passage in the manner provided
by law.
