HomeMy WebLinkAboutG35-90 Ordinance No. G35-90 AN ORDINANCE GRANTING A SPECIAL USE FOR AN OFF-STREET PARKING LOT WHEREAS, written application has been made for an off-street parking lot at 361 Hickory Place; and WHEREAS, the Land Use Committee conducted a public hearing after due notice by publication and has submitted its findings of fact. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section I. That the City Council of the City of Elgin hereby finds and determines a special use for off-street parking at 361 Hickory Place is necessary to promote redevelopment of the adjacent lot for business use and to provide a buffer between the business use and residential uses. The City Council further finds that the proposed special use upon the conditions hereinafter set forth are so designed, located and proposed to be operated so that the public health, safety and welfare will be protected since no business use will be established on the subject property which will divide residential uses and the adjoining business use. The City Council further finds that the proposed use will not cause substantial injury to the property or to the property in the neighborhood in which it is located in that appropriate conditions will be placed upon the special use to protect surrounding properties from diminution in value and use and enjoyment. Section 2. That a special use for an off-street parking lot at 361 Hickory Place, Elgin, Illinois, legally described as follows: The West Half of Lot 2 of Brown's Subdivision of Lot 12 of P.J. Kimball Sr.'s Addition to Elgin, in the City of Elgin, Kane County, Illinois. be and is hereby granted subject to the following conditions: I. Access shall be limited to one curb cut on Hickory Place. 2. A solid landscape screen between the parking lot and the south and east property lines shall be installed and thereafter maintained. 3. Full compliance with all applicable codes and ordinances. Section 3. That the special use granted herein shall expire if not established within one year from the date of passage of this ordinance. Section 4.
