HomeMy WebLinkAboutG60-89 Ordinance No. G60-89 AN ORDINANCE GRANTING A SPECIAL USE FOR A CHURCH - (1 1 10 Summit Street) WHEREAS, written application has been made for a special use for the establish- ment, maintenance and operation of a church at 1 1 10 Summit Street; and WHEREAS, the Land Use Committee conducted a public hearing after due notice by publication and has submitted its findings of fact and recommended approval; and WHEREAS, the City Council of the City of Elgin concurs in the findings and recommendation of the Land Use Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section I. That the City Council of the City of Elgin hereby adopts the findings of fact made by the Elgin Land Use Committee, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. Section 2. That a special use for a church at 1 1 10 Summit Street, Elgin, Illinois, legally described as follows: That part of the Southwest Quarter of the Southeast Quarter of Section 7, Township 41 North, Range 9, East of the Third Principal Meridian, described as follows: Beginning at the Northeast Corner of the Southwest Quarter of said Southeast Quarter; thence South I degree 13 minutes West along the East Line of said Southwest Quarter of the South- east Quarter, 776.0 feet to the North line of State Route 58; thence South 89 degrees 49 minutes West along said North Line, 341.18 feet; thence North I degree 13 minutes East parallel with the East line of the Southwest Quarter of the Southeast Quarter 759.59 feet to a point in the North Line of said Southwest Quarter of the Southeast Quarter; thence North 87 degrees 30 minutes East along said North Line, 341.53 feet to the point of beginning, except therefrom the South 508.36 feet of the East 150.0 feet thereof, in the City of Elgin, Cook County, Illinois. be and is hereby granted subject to the following conditions: I. Substantial conformance with the site plan prepared by ACBI Architects, dated March 30, 1989. 2. Submission of an !DOT permit for roadway access to Summit Street prior to the issuance of a building permit. 3. Compliance with all other applicable codes and ordinances. Section 3. That the special use granted herein shall expire if not established elk within one year from the date of passage of this ordinance. Section 4. James A .M . E. Church , as Applicant and Owner . II . CONSIDERATIONS A petition has been filed by the St . James A .M . E . Church requesting an R- 2 Single Family Residence District special use for a church . The subject property is located at 1110 Summit Street . The petitioner intends to develop the subject property with a church and accessory off- street parking . The proposed church would seat 231 parishoners . IlI . FINDINGS After due notice , as required by law , the Land Use Committee held a public hearing on the proposed special use for a church on May 15 , 1989 . The petitioner testified at the hearing and presented documentary evidence . No objectors appeared at the hearing and no written objection to the petition has been filed . The Land Use Committee has made the following findings with respect to Petition 42- 89 : A . Site Characteristics : The subject property is an irregularly shaped parcel containing approximately 4 . 26 acres . Elevations range from approximately 788 to 801 feet . The maximum relief of the property is 13 . 7 feet , sloping downward in a northerly direction toward the rear of the subject property . B . Sewer and Water : The subject property can be served by a 24 inch watermain and an eight inch sanitary sewer line . There are no capacity limitations for the proposed use at this location . - Page 1- Exhibit A rink C . Traffic and Parking : Summit Street functions as a major east-west arterial street serving the east central portion of the city. Summit Street has a design capacity of between 16 ,000 and 18 ,000 vehicles per day . Currently , Summit Street carries approximately 14 ,400 vehicles per day. Traffic projections for a church are not available . The off- street parking requirements for a church use are at least one space for each person employed on the premises and one additional space for each five seats , or 90 inches of seating space , in the main auditorium or assembly hall . The proposed church would require 46 off- street parking spaces ( 231/5 ) , plus additional spaces for employees . Zoning Status : The subject property is of adequate size and shape to be developed in accordance with Elgin ' s zoning regulations . F. Surrounding Land Use and Zoning : The area located to the north of the subject property is zoned R-4 General Residence District . The area is to be developed with townhomes (Cobbler ' s Crossing Subdivision) . The area located to the south of the subject property is zoned R- 2 Single Family Residence District . The area is developed primarily with single family dwellings . A church is located on the parcel immediately south of the subject property. The area located to the west of the subject property is zoned R- 4 General Residence District . The area is to be developed with townhomes (Cobbler ' s Crossing Subdivision) . The area to the east of the subject property is zoned R- 2 Single Family Residence District . The area is developed with a single family dwelling . Trend of Development : The portion of Summit Street along which the subject property is located , is developing with residential uses . H . Comprehensive Plan : The subject property is designated as "urban residential " . The portion of the property fronting along Summit Street has a "transportation corridor" designation . I . Conditions for Approval : The Land Use Committee is of the opinion that approval of Petition 42- 89 should be subject to the following conditions : 1 . Substantial conformance with the site plan prepared by ACBI Architects , dated March 30 , 1989 . 2 . Submission of an IDOT permit for roadway access to Summit Street prior to the issuance of a building permit . 3 . Compliance with all other applicable codes and ordinances . J . Special Use Standard : The Land Use Committee has found that the proposed special use for a church is in substantial conformance with the special use standards . IV . RECOMMENDATION On a motion to recommend approval of Petition 42- 89 , subject to the conditions for approval , the vote was four (4) yes and zero (0 ) no .
