G10-87 GRANTING A SPECIAL USE FOR A DAY CARE CENTER BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section I. That Section I of Ordinance No. G10-87 entitled "An Ordinance Granting a Special Use for a Day Care Center" passed February 25, 1987, be and is hereby amended to read as follows: "Section I. That the City Council of the City of Elgin hereby adopts the findings of fact made by the Land Use Committee, a copy of which is attached hereto as Exhibit A." Section 2. That Section 2 of Ordinance No. GI0-87 entitled "An Ordinance Granting a Special Use for a Day Care Center" passed February 25, 1987, be and is hereby amended by adding the following conditions: 3. Substantial conformance with the site plan, prepared by Sinnett Builders, dated March 17, 1989 and the petitioner's statement. Section 3. That, except as amended herein, Ordinance No. G10-87 remains in full force and effect. Section 4. SUBJECT Consideration of Petition 36-89 Requesting an Amendment to Ordinance Number G10-87 , Granting a Special Use for a Day Care Center , property located at 845 Summit Street , by Patrick and Katherine Hannell , as Applicants and Owners . II . CONSIDERATIONS A petition has been filed by Katherine and Patrick Hannell , requesting an amendment to Ordinance Number G10-87 which established a special use for a day care center . The subject property is located at 845 Summit Street . The petitioners desire to expand the established day care center at the subject property . The day care center addition will contain approximately 3 , 198 square feet , and nineteen ( 19) additional off-street parking spaces will be provided . III . FINDINGS After due notice , as required by law , the Land Use Committee held a public hearing on the proposed special use amendment on May 1 , 1989 . The petitioner testified at the hearing and presented documentary evidence . No objectors appeared at the public hearing and no written objection to the petition has been filed . The Land Use Committee has made the following findings with respect to Petition 36-89 : A . Site Characteristics : The subject property is a regularly shaped parcel containing approximately one ( 1 ) acre . The maximum relief is 11 feet . The subject property is improved with a 7 ,605 square foot day care center building , a 6 , 300 square foot playground , and twenty-two (22) off-street parking spaces . B . Sewer and Water : The subject property is served by a twelve ( 12) inch watermain and a twelve ( 12) inch sanitary sewer . There are no capacity limitations associated with the proposed expansion . Summit Street has a design capacity of 16 ,000 to 18 , 000 vehicles per day . Currently , Summit Street carries approximately 14 , 400 vehicles per day . An estimated four vehicle trips per day per student and per employee would be generated . Based upon 166 students and 22 employees , 752 vehicle trips per day would be generated , increasing traffic on Summit Street to 15 , 152 vehicles per day . The Off-street Parking Ordinance requires one off-street parking space per employee plus one space per every 10 students . Based upon 22 employees and 166 students , 38 off-street parking spaces would be required . The petitioner is proposing 41 spaces . D . Zoning History : The subject property was annexed and zoned B-3 in 1964 . E. Zoning Status : The subject property is a lawful , conforming B-3 Special Use with respect to bulk requirements and use . F. Surrounding Land Use and Zoning : The area surrounding the subject property is zoned B-3 and is developed with a mix of retail and service uses , including a shopping center and a physicians ' office complex . G. Trend of Development : The property fronting on Summit Street , west of Hiawatha Drive , has developed with retail amd commercial service uses which serve the east central portion of the city . H . Special Use Standards : The proposed special use amendment is in substantial conformance with the special use standards . I . Conditions for Approval : The Land Use Committee is of the opinion the Petition 36-89 should be subject to the follow- ing conditions : 1 . Substantial conformance with the site plan , prepared by Sinnett Builders , dated March 17 , 1989 , and the petitioner ' s statement . 2 . RECOMMENDATION On a motion to recommend approval of Petition 36-89 , subject to the conditions for approval , the vote was seven ( 7) yes and zero (0) no .
