Ordinance No. G32-89
AN ORDNANCE
CLASSIFYING CERTAIN NEWLY ANNEXED TERRITORY AND GRANTING
A SPECIAL USE FOR A SKILLED CARE NURSING FACILITY
(1425, 1435 and 1455 Summit Street)
WHEREAS, the territory herein described has been annexed to the City of Elgin;
and
WHEREAS, written application has been made to classify said territory in the R-4
General Residence District; and
WHEREAS, after due notice in the manner provided by law the Land Use
Committee conducted a public hearing concerning said application and has submitted its
written findings and recommendation; and
WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings
and recommendations of the Land Use Committee and concurs in its recommendation.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section I. That Chapter 19.08, Section 19.08.020, entitled "Zoning District Map"
of the Elgin Municipal Code, 1976, as amended, be and the same is hereby further
amended by adding thereto the following paragraph:
"The boundaries hereinbefore laid out in the 'Zoning District Map', as
amended, be and are hereby altered by including in the R-4 General
Residence District, the following described property:
That part of the Southwest Quarter of Section 8, Township 41 North,
Range 9 East of the Third Principal Meridian described as follows:
Commencing at the Southeast corner of said Southwest quarter; thence
South 88 degrees 01 minutes West along the South line of said Southwest
quarter, a distance of 752.30 feet for the place of beginning; thence con-
tinuing South 88 degrees 01 minutes West along said South line, a distance
of 609.0 feet to the Easterly line of Commonwealth Edison Company right
of way; thence North 00 degrees 41 minutes East along said Easterly line, a
distance of 364.2 feet to the Southerly line of State Route 58; thence North
89 degrees 00 minutes East along said Southerly line, a distance of 40.02
feet to the Easterly line of Commonwealth Edison Company right of way;
thence North 00 degrees 41 minutes East along said Easterly line, a
distance of 100.04 feet to the Northerly line of State Route 58; thence
North 89 degrees 00 minutes East along said Northerly line, a distance of
567.98 feet; thence South 00 degrees 41 minutes West, a distance of 452.49
feet to the place of beginning. Being situated in Hanover Township, Cook
County, Illinois."
Section 2. That the City Council of the City of Elgin hereby adopts the findings
of fact mode by the Elgin Land Use Committee, a copy of which is attached hereto as
Exhibit A and incorporated herein by reference.

Section 3. That a special use for a skilled nursing care facility for the property
legally described as follows:

is hereby granted subject to the following terms and conditions:
/" I. Compliance with the terms and conditions of the annexation
agreement.
2. Substantial conformance to the site plan dated October 24, 1988.
3. Compliance with all other applicable codes and ordinances.
Section 4. That this ordinance shall be in full force and effect from and after its
passage and approval in the manner provided by law and shall be published in pamphlet
form by authority of the City Council.

FINDINGS OF FACT
LAND USE COMMITTEE
PLANNING AND LAND USE COMMISSION
CITY OF ELGIN
I . SUBJECT
Consideration of Petition 54- 88 Requesting Annexation , R-4
General Residence District Zoning , and a Special Use for a
Nursing Home , property located at 1425 and 1455 Summit Street
by Robert L. and Juil P. Wasmond , as Applicants and Owners .
II . CONSIDERATIONS
A petition has been filed by Robert and Juil Wasmond which
requests an R-4 General Residence District zoning with a
special use for a skilled care nursing facility. The subject
property is located on the south side of Summit Street , east
of the Commonwealth Edison transmission lines .
The petitioner is requesting a special use in the R-4 General
Residence District to allow for the existing skilled care
' nursing facility, and to provide for its future expansion .
III . FINDINGS
After due notice , as required by law, the Land Use Committee
held a public bearing on the proposed Annexation , R-4 Zoning _
and Special Use for a Nursing Home on August 15 , 1988 . The
petitioner testified at the public hearing and presented
documentary evidence . No objectors appeared at the hearing .
and no written objection to this petition has been filed .
The Land Use Committee has made the following findings with
respect to Petition 54-88 :
A. Site Characteristics : The subject property is a
rectangularly shaped parcel containing approximately 6 . 3
acres . The subject property contains two ( 2) buildings .
The property is improved with a nursing home and a single
family residence . The petitioner is planning to increase
the level of care of the nursing home from 50 beds to 98
beds .
The maximum relief on the subject property is ten ( 10)
feet . The property slopes downward in a northwesterly
direction .

B. Zoning History: The subject property is located in
unincorporated Cook County and is zoned R-4 Single Family
Residence District .
C. Surrounding Land Use and Zoning : The area located to the
north of the subject property is in unincorporated Cook
County and is zoned R-3 Single Family Residence District .
The area is generally undeveloped. The Church of the
Nazarene is located directly northeast of the subject
property.
The area located to the south of the subject property is
currently in agricultural use . The area has recently
been considered by the City Council for annexation and
developaent with 215 single family residences .
The area located to the west of the subject property is
developed with the Commonwealth Edison transmission
lines .
The area to the east of the subject property is located
in unincorporated Cook County and is zoned R-4 Single
Family Residence. District . With the exception of one
single family residence , the area is largely undeveloped .
eft D. Trend of Development : The subject property is located at
the eastern edge of an urban residential pattern of
developaent. -
E. Traffic and Parking : Summit Street functions as a major
east-west arterial street for the east central portion of
the city. Summit Street has a design capacity of between
16 ,000 and 18 ,000 vehicles per day. Currently Summit
Street carries approximately 14 ,400 vehicles per day.
Nursing homes generate an average of 2 . 6 weekday vehicle
trips per bed . The proposed 98 bed skilled care nursing
facility could generate an additional 255 vehicle trips
per weekday onto Suaait Street . The projected traffic
volumes on Summit Street could increase from 14 ,400
vehicles per day to 14 ,655 vehicles per day.
The nursing home (after expansion) would have a maximum
of 50 employees working during any one shift , and would
contain 98 beds . The off-street parking ordinance
requires one ( 1) parking space per every three (3) beds
in the nursing hose and one ( 1) space per employee . The
required number of off-street parking 'spaces for the
proposed developaent would be 83 parking spaces .

O'` F. Sewer and Water: The subject property can be served by
an eight (8) inch sanitary sewer line and a six (6) inch
watermain. There are no capacity limitations for the
proposed use at this location.
G. Comprehensive Plan : The Comprehensive Plan designates
the area in which the subject property is located as
Estate Residential , abutting Urban Residential
immediately to the west . Upon annexation to the city ,
the subject property would be classified as Urban
Residential . The urban residential designation
contemplates a range of housing types and densities
served by municipal facilities . The subject property is
located in the phase one growth area as designated in the
Growth Management Plan (see the Official Comprehensive
Plan) .
H. Suitability of Present Zoning : The committee has found
that the development proposal should be approved based on
the surrounding land use and coning , the trend of
development in the area , and the goals and objectives and
policies of the Coapehensive Plan.
I . Special Use Standards : The committee has found that the
proposed special use for a nursing hone is in substantial
conformance with the special' use standards .

J. Conditions for- Approval : The Land Use Committee is of
the opinion that approval for Petition 54-88 should be
subject to the following conditions :
1 . Revisions to the annexation agreement per the Legal
Department , Engineering Division and the Planning
Department .
2. Compliance with the terms and conditions of the
revised annexation agreement .
3 . Revisions to the proposed site plan per the Bureau of
Inspection Services , the Engineering Division , and
the Planning Department .
4. Substantial conformance to the revised site plan .
5 . Compliance with all other applicable codes and
ordinances .
IV. RECOMMENDATION
On a motion to recommend approval of Petition 54-88 , subject
to the conditions for approval , the vote was six (6) yes ,
zero (0) no and one ( 1) abstention .

Therefore , the Land Use Committee recommends approval of
Petition 54-88 .
