HomeMy WebLinkAbout G90-89 Ordinance No. G90-89 AN ORDINANCE GRANTING A SPECIAL USE FOR A RECREATIONAL BUILDING WHEREAS, written application has been made for a special use for the establish- ment, maintenance and operation of a recreational building at 1020 North McLean Boulevard; and WHEREAS, the Land Use Committee conducted a public hearing after due notice by publication and has submitted its findings of fact and recommended approval; and WHEREAS, the City Council of the City of Elgin concurs in the findings and recommendation of the Land Use Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section I. That the City Council of the City of Elgin hereby adopts the findings of fact made by the Elgin Land Use Committee, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. Section 2. That a special use for a recreational building at 1020 North McLean Boulevard, Elgin, Illinois, legally described as follows: That part of the Northwest Quarter of Section 10, Township 41 North, Range 8 East of the Third Principal Meridian, described as follows: Beginning at the point of intersection of the center line of Sleepy Hollow Road with a line drawn parallel with and 50 feet northerly of, measured at right thereto, the center line of the main track of the Chicago and North- western Railway Company as said track was located on April 12, 1971; thence North 79 degrees 56 minutes West along said parallel line 740 feet to the easterly line extended southerly of premises conveyed to Chicago and Pacific Railroad Company, by deed recorded December 27, 1892 in Book 321 , Page 304 as Document 527; thence North 0 degrees 55 minutes East along the extension of and the easterly line of said premises, 189.1 feet to the southerly line of premises conveyed to said Chicago and Pacific Railroad Company, by deed recorded December 16, 1876 in Book 164, Page 575 as Document 117; thence South 89 degrees 05 minutes East along said southerly line, 725.80 feet to the center line of said Sleepy Hollow Road; thence South along said center line, 307 feet to the point of beginning, in the City of Elgin, Kane County, Illinois." be and is hereby granted subject to the following conditions: I. Substantial conformance with the revised Valley Business Centre site plan, dated September 20, 1989. 2. Conformance with the petitioner's statement. 3. Compliance with all other applicable codes and ordinances. Section 3. That the special use granted herein shall expire if not established within one year from the date of passage of this ordinance. SUBJECT Petition 75-89 Requesting a M- 1 Limited Manufacturing District Special Use for a Recreational Building , property located at 1020 North McLean Boulevard by Northern Illinois Fitness , Incorporated , as Applicant , and Trust *Lt-86-035 Northwest Commercial Bank , as Owner . II . CONSIDERAT19NS A petition has been filed by Northern Illinois Fitness , Inc . requesting an M- 1 General Manufacturing District Special Use for a recreation building . The subject property is located at 1020 N. McLean Boulevard . The applicant proposes to develop the subject property with a Gold ' s Gym Fitness Center. The proposed fitness center will occupy approximately 12 , 100 square feet of space within an existing building associated on the site . The fitness center will contain exercise machines and equipment designed for toning and cardiovascular conditioning . III . FINDINGS After due notice , as required by law , the Land Use Committee held a public hearing on the proposed special use for a recreational building on September 5 , 1989 . The petitioner testified at the hearing and presented documentary evidence . No objectors appeared at the hearing and no written objection has been filed . The Land Use Committee has made the following findings with respect to Petition 75-89 : A. Site Characteristics : The subject property is an irregularly shaped parcel containing approximately 4 .4 acres . The property is improved with a multiple tenant commercial/industrial building and accessory parking . eft -Page 1- Exhibit A r B. Sewer and Water : The subject property can be serviced through an eight (8) inch sanitary sewer and a twelve ( 12) inch storm sewer which are currently located south of the subject property. The property can be served through a ten ( 10) inch watermain located in the North McLean Boulevard right of way. There are no water , sanitary sewer or storm sewer limitations associated with the proposed use of this property. However , the subject property is located in a service area where water and sanitary sewer systems will need to be upgraded as development pressure increases . Source: Engineering Division , City of Elgin . C. Traffic and Parking : North McLean Boulevard is designated as a major north-south arterial street serving the west side of the city. North McLean Boulevard has a design capacity of approximately 17 , 230 vehicles per day. The street currently carries approximately 20 ,800 vehicles per day. Recreation buildings generate approximately 11 . 7 week day vehicle trips ends per 1 ,000 gross square feet of building area . Accordingly, the proposed 12 , 100 square foot fitness center can be expected to generate approximately 142 weekday vehicle trip ends . The off street parking requirement for a recreation building is at least one space per every 100 square feet of floor area . The required number of parking spaces for the proposed fitness center would be 121 . There is adequate space available on the property to provide approximately 240 parking spaces . The 240 spaces meet the parking requirements for both the existing uses and the proposed fitness center. Sources : City of Elgin , Engineering Division . Zoning History: The subject property was annexed and zoned M- 1 in 1972 . E. Zoning Status : The subject property is occupied with conforming commercial/industrial uses . emk -Page 2- eft. F. Surrounding Land Use and Zoning : The area located to the north of the subject property is zoned B-3 and B-4 . The area is improved with commercial uses . The area located to the east of the subject property is zoned B-4 and M- 1 . The area is improved with commercial uses and light industrial uses . The area located to the south is zoned 0 . The area is developed with office and business uses . The area located to the west is in unincorporated Kane County and is developed with railroad rights of way. G. Trend of Development : The area in which the subject property is located is developed with light industrial and commercial uses . H. Comprehensive Plan : The subject property is located in an area designated "area commercial center" . I . Special Use Standards : The Land Use Committee has found that the proposed special use for a recreational building is in substantial conformance with the special use standards . J. Conditions for Approval : The Committee is of the opinion that approval of Petition 75-89 should be subject to the following conditions : 1 . Revisions to the site plan to provide 240 off-street parking spaces per the Planning Department . 2 . Conformance with the revised site plan . 3 . Conformance with the petitioner 's statement . 4 . Compliance with all other applicable codes and ordinances . IV. BECOMMENDATIONS On a motion to recommend approval of Petition 75-89 , subject to the conditions for approval , the vote was seven (7) yes and zero (0) no .
