AN ORDINANCE
GRANTING A SPECIAL USE FOR A CHURCH
WHEREAS, written application has been made for a special use for the establish-
ment, maintenance and operation of a special use for a church at 400 Federation Place;
and
WHEREAS, the Land Use Committee conducted a public hearing after due notice
by publication and has submitted its findings of fact and recommended approval; and
WHEREAS, the City Council of the City of Elgin concurs in the findings and
recommendation of the Land Use Committee.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section I. That the City Council of the City of Elgin hereby adopts the findings
of fact made by the Elgin Land Use Committee, a copy of which is attached hereto and
made a part hereof by reference as Exhibit A.
Section 2. That a special use for a church at 400 Federation Place, Elgin, Illinois,
legally described as follows:
That part of Lots II, 12, 13, 14, 15 and 16 and part vacated Leslie
Street lying southerly of and adjoining said Lots 11, 12, and 13, all in Fox
Ridge Unit No. I, all described as follows: Commencing at the point of
intersection of the East line of fractional Section 2, Township 41 North,
Range 8, East of the Third Principal Meridian with the southerly line of a
tract of land conveyed to Northern Illinois Gas Company by deed recorded
November 28, 1958 as Document 876705; thence South 89 08 minutes West
along the southerly line of said Gas Company tract, and along the southerly
line of a tract of land conveyed to Northern Illinois Gas Company by deed
recorded November 28, 1958 as Document 876688, 1087.23 feet for the
point of beginning; thence South I East 233 feet; thence westerly, parallel
with the southerly line of said Northern Illinois Gas Company tract, 267.79
feet to the westerly line of Lot 16 of said Fox Ridge, Unit No. I; thence
northerly along the westerly line and westerly line extended of said Lot 16,
and along the westerly line of said Lot 11 of Fox Ridge Unit No. I, 233 feet
to a point 109.5 feet northerly of the Southwest corner of said Lot I I (also
being an angle point in the line of the Gas Company tract acquired by said
Document 876688); thence easterly 167.65 feet to the point of beginning) in
the City of Elgin, Kane County, Illinois.
be and is hereby granted subject to the following conditions:
I. The special use for a church is limited to the lower level of the
building.
2. Submission and approval of a parking lot site plan, and monetary
assurance to guarantee its development during the next construction
season.
3. Provide a minimum of 60 off-street parking spaces.
4. Compliance with all other applicable codes and ordinances.
Section 3. That the special use granted herein shall expire if not established
within one year from the date of passage of this ordinance.
Section 4. That this ordinance shall be in full force and effect from and after its
passage in the manner provided by law.

I . SUBJECT
Consideration of Petition 88- 89 Requesting a B- 3 Service
Business District Special Use for a Church , property
located at 400 Federation Place , by Tyler Creek Christian
Assembly , as Applicant , and ,N and M Investments , as Owners .
II . CONSIDERATIONS
A petition has been filed by the Tyler Creek Christian
Assembly requesting a B- 3 Service Business District special
use for a church . The subject property is located at 400
Federation Place .
The petitioner desires to occupy a portion of the existing
multiple tenant commercial building with a church . Other
tenants include office uses and a school .
11I . FINDINGS
After due notice , as required by law , the Land Use
Committee held a public hearing to consider the proposed
special use for a church on October 2 , 1989 . The
petitioner testified at the hearing and presented
documentary evidence . No objectors appeared at the
hearing . No written objection has been filed .
The Land Use Committee has made the following findings with
respect to Petition 88- 89 :
A . Site Characteristics : The subject property is a
rectangularly shaped parcel containing approximately
1 . 43 acres . The subject property is improved with a
1500 square foot commercial building and accessory
off- street parking .
B . Sewer and Water : The subject property is serviced by
an eight (8 ) inch sanitary sewer line and a six ( 6)
inch watermain . Stormwater drains overland into Tyler
Creek and the Fox River .

eft C . Traffic and Parking : Federation Place functions as a
local street serving Fox Ridge Subdivision and the
subject property . Federation Place has a design
capacity of approximately 1 ,000 vehicles per day. No
traffic counts are available for Federation Place .
Trip generation figures are not available for churches
and sufficient data has not been supplied to calculate
the number of trips generated by the school . However ,
it is important to note the hours of operation for both
the church and the school . The church conducts
traditional services on Sunday mornings and has related
activities on Wednesday evenings , from 7 : 30 - 9 : 00 P . M .
The school holds classes Monday through Friday from
4 : 00 - 10 : 00 P . M .
The building includes approximately 700 square feet of
occupied office space , not associated with either the
church or the school . Offices generate approximately
17 . 7 weekday vehicle trips per 1 ,000 square feet of
building area . Accordingly , these additional offices
could generate approximately 12 weekday vehicle trips .
Should the entire 15 ,000 square foot building be
occupied with offices , a total of 265 weekday vehicle
trips could be generated .
eft The required number of off- street parking spaces is
based on the number of seats in assembly areas , and the
number of employees for churches and schools ; and on
gross floor area ( 2 space/250 sq . ft . ) for offices .
The required number of parking spaces based on the
current use of the building is 36 . The site plan
indicates a total of 26 spaces . One hundred percent
occupancy of the building with office uses would
require 60 spaces .

1969 and is presently zoned B- 3 .
E. Zoning Status : Churches are listed as special uses in
the B- 3 District . The existing office uses and school
are permitted in the B- 3 District .

F . Surrounding Land Use and Zoning : The areas located to
r the north , northwest , east , and south of the subject
property are zoned B- 3 . The Holiday Inn and the Elgin
Riverside Treatment Plant are located to the east and
southeast of the subject property.
Portions of the area located to the west of the subject
property are zoned R- 3 , B- 1 and B- 3 . The properties
zoned for residential use are developed with single
family and two family residences .
G . Trend of Development : The subject property is located
along the Northwest Tollway corridor . The tollway
corridor is developing with commercial areas centered
around major interchanges , and office/research/light
industrial uses .
H . Comprehensive Plan : The subject property is designated
"urban residential" . However , the Northwest Tollway is
designated as a "transportation corridor" . Property
with exposure to the Northwest Tollway may be developed
in a more intense land use pattern .
I . Special Use Standards : The committee has found the
proposed special use for a church to be in substantial
conformance with the special use standards .
eft J . Conditions for Approval : The committee is of the
opinion that approval of Petition 88- 89 should be
subject to the following conditions :
1 . The special use for a church is limited to the
lower level of the building .
2 . Submission and approval of a parking lot site plan ,
and monetary assurance to guarantee its development
during the next construction season .
3 . Provide a minimum of 60 off- street parking spaces .
4 . Compliance with all other applicable codes and
ordinances .

IV . RECOMMENDATION

subject to the conditions for approval , the votes was seven

Therefore , the Land Use Committee recommends approval of
