HomeMy WebLinkAboutG73-88 • Ordinance No. G73-88 AN ORDINANCE GRANTING A SPECIAL USE FOR A CHURCH (156 Willard Avenue) WHEREAS, written application has been made for a special use for the establish- ment, maintenance and operation of church at 156 Willard Avenue; and WHEREAS, the Land Use Committee conducted a public hearing after due notice by publication and has submitted its findings of fact and recommended approval; and WHEREAS, the City Council of the City of Elgin concurs in the findings and recommendation of the Land Use Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section I. That the City Council of the City of Elgin hereby adopts the findings of fact made by the Elgin Land Use Committee, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. Section 2. That a special use for a church at 156 Willard Avenue, Elgin, Illinois, legally described as follows: That part of Lot 22 of the County Clerk's Division of Unsubdivided Lands in the South Half of Section 18, Township 41 North, Range 9 East of the Third Principal Meridian, in Cook County, Illinois described as follows: Beginning in the East Line of said Lot 22 at a point 140.29 feet South of the Northeast Corner of said Lot 22, thence South along the said East Line of said Lot 22, 283.0 feet; thence West parallel with the North line of said Lot 22, 183.0 feet, thence North parallel with the East Line of said Lot 22, 283.0 feet thence East parallel with the North Line of said Lot 22, 183.0 feet, to the point of beginning excepting therefrom that part of the above described premises now included in streets, in the City of Elgin, Cook County, Illinois, except that part being legally described as follows: That part of Lot 22 of the County Clerk's Division of Unsubdivided Lands in the South Half of Section 18, Township 41 North, Range 9 East of the Third Principal Meridian, described as follows: Commencing at the Northeast Corner of said Lot 22; thence South 01 degree 10 minutes 00 seconds West along the East Line thereof 323.39 feet; thence North 89 degrees 51 minutes 38 seconds West and parallel with the North Line of said Lot 22, a distance of 33.0 feet to the West Line of Willard Avenue for the point of beginning; thence continuing North 89 degrees 51 minutes 38 seconds West along the last described line 150.0 feet; thence South 01 degree 10 minutes 00 seconds West and parallel with the East Line of said Lot 22, a distance of 100.0 feet; thence South 89 degrees 52 minutes 38 seconds East and parallel with the North Line of said Lot 22, a distance of 150.0 feet to the West Line of Willard Avenue; thence North 01 degree 10 minutes 00 seconds East along said West Line 100.0 feet to the point of beginning, in the City of Elgin, Cook County, Illinois. be and is hereby granted subject to the following conditions: Alok I. Substantial conformance to the site plan prepared by Edwin Noel Gatlag, dated May 9, 1988. 2. Special use will be in effect for two (2) years following ratifica- tion by the City Council. 3. Compliance with all other applicable codes and ordinances. Section 3. That the special use granted herein shall expire if not established within one year from the date of passage of this ordinance. Section 4. SUBJECT Consideration of Petition 52-88 Requesting a B-4 General Service District Special Use for a Church , property located at 156 Willard Avenue by Sam Cortez , as Applicant and Leonard Spates , as Owner. II . CONSIDERATIONS A petition has been filed by the Reverend Sam Cortez requesting a B-4 General Business District Special Use for a church . The subject property is located at 156 Willard Avenue few The applicant proposes to develop the subject property with F a church. The proposed development comprises a 2 ,880 square foot church which seats 140 people. The proposed development will also contain a children' s play area located to the west of the church structure and required off-street parking (see Exhibits D and E) . III . FINDINGS After due notice , as required by law, the Land Use Committee held a public hearing on the proposed special use on August 1 , 1988 . the petitioner testified at the public hearing and presented documentary evidence . No objectors appeared at the hearing and no written objection to this petition has been filed . The Land Use Committee has made the following findings with respect to Petition 52-88 : A. Site Characteristics : The subject property is a regularly shaped parcel containing approximately 27 ,450 square feet ( 150 x 183) . The property is improved with a one-story, frame , single family residence . B. Sewer and Water : The subject property is served with a twelve ( 12) inch and a six ( 6) inch watermain located along Willard Avenue . The property can be served Exhibit A —1— through a twenty- one ( 21 ) inch san. t , : y sewer located along Willard Avenue and a ten ( 10) inch sanitary sewer located along Laurel Street . Stormwater drains to the west into Willow Creek . Any new development of the property must meet the requirements of the E.M. C. 18 . 36 - Stormwater Control . There are no water or sanitary sewer limitations associated with the proposed use of the property. City of Elgin , Engineering Division . C . Traffic and Parking : Willard Avenue functions as a north-south collector street between East Chicago Street and Villa Street . Current traffic volume on Willard Avenue is approximately 5 ,376 vehicles per day. Willard Avenue has a design capacity of approximately 14 ,000 vehicles per day. The information needed to calculate the number of vehicle trips generated from the proposed development is not available . elk The off-street parking requirement for a church is at least one space for each employee on the premises and one additional space for each five (5) seats , or ninety ( 90) inches of seating space in the main assembly hall . The development plan submitted with this application includes thirty-five ( 35) off-street parking spaces including two ( 2) handicapped spaces . Zoning Status : The subject property is improved with a lawful nonconforming single family residence . F. Surrounding Land Use and Zoning : The areas located to the north , south , and west of the subject property are -2- zoned M- 1 . These areas are developed with a food distribution business and an automobile parts an4 salvage business . The area located to the east of the subject property is zoned B-4. The area is largely undeveloped . The areas located farther to the south and east of the subject property are developed with various business uses , an apartment complex and a mobile home park . G. Trend of Development : The area in which the subject property is located has experienced generally piecemeal and unrelated development . The most prominent pattern of development has been the location of several automobile dealerships along East Chicago Street . The areas located to the south and east of the subject property include a variety of zoning classifications and a corresponding variety of land uses . H. Comprehensive Plan: The subject property is located in an area designated mixed commercial and industrial . I . Special Use Standards : The Land Use Committee has found that the proposed special use is in substantial eft conformance to the special use standards . J. Conditions for Approval : The Land Use Committee is of the opinion that approval of Petition 52-88 should be subject to the following conditions : 1. Substantial conformance to the site plan prepared by Edwin Noel Gatlag , dated May 9 , 1988. 2 . Special Use will be in effect for two ( 2) years following ratification by the City Council . 3 . Compliance with all applicable codes and ordinances . IV. RECOMMENDATION On a motion to recommend approval of Petition 52-88 , subject to the conditions for approval , the vote was six (6) yes and zero (0) no .
