HomeMy WebLinkAboutG66-88 Ordinance No. G66-88 AN ORDINANCE GRANTING A SPECIAL USE FOR A PLANNED UNIT DEVELOPMENT WHEREAS, written application has been made for a special use for the establish- ment, maintenance and operation of a planned unit development at the northeast corner of Lovell Road and Villa Street; and WHEREAS, the Land Use Committee conducted a public hearing after due notice by publication and has submitted its findings of fact and recommended approval; and WHEREAS, the City Council of the City of Elgin concurs in the findings and recommendation of the Land Use Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section I. That the City Council of the City of Elgin hereby adopts the findings of fact made by the Elgin Land Use Committee, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. Section 2. That a special use for a planned unit development at the northeast corner of Lovell Road and Villa Street, Elgin, Illinois, legally described as follows: That part of Section 20, Township 41 North, Range 9 East of the Third Principal Meridian described as follows: Commencing at a point in the center line of U.S. Route 20 where the east line of the west half of the southwest quarter of said Section 20 crosses said center line; thence south- easterly along said center line 52.4 feet to the easterly line of a tract of land conveyed to Public Service Company of Northern Illinois (now Commonwealth Edison Company) by Document Number 9542306; thence northerly along said easterly line 114.22 feet to an angle in said easterly line; thence northeasterly along said easterly line 76.81 feet to the northerly line of a tract of land dedicated for highway purposes by Docu- ment Number 17993033; thence southeasterly along said northerly line 41.55 feet to a line 40.0 feet easterly of (measured at right angles thereto) and parallel with the easterly line of lands conveyed by Document Number 9542306 for the place of beginning; thence northeasterly along said parallel line 1726.36 feet to the southerly line of Lot C in Section 20, according to the plat filed with the commissioners report in partition in Case No. 19700 in the Circuit Court of Cook County, Illinois; thence southeasterly along said southerly line and along said southerly line extended, 1563.62 feet to the westerly right-of-way line of the Elgin, Joliet and Eastern Railway; thence southwesterly along said westerly right-of-way line 1696.69 feet to a point in said right-of-way line that is 400.0 feet northerly of (measured along said right-of-way line) the northerly line of lands dedicated for highway purposes by Document Number 9171745; thence northwesterly parallel with the northerly line of lands dedicated by Document Number 9171745, a distance of 215.08 feet; thence southwesterly parallel with the westerly right-of-way line of the Elgin, Joliet and Eastern Railway 200.0 feet; thence southeasterly parallel with the northerly line of lands • dedicated for highway purposes by Document Number 9171745, a distance of 215.08 feet to the westerly right-of-way line of the Elgin, Joliet and Eastern Railway; thence southwesterly along said westerly right-of-way line 200.0 feet to the northerly line of lands dedicated for highway purposes by Document Number 9171745; thence north 76 degrees 58 minutes west 669.0 feet to an angle in said northerly line; thence north 79 degrees 06 minutes west along said northerly line 100.25 feet to an angle in said northerly line; thence north 76 degrees 06 minutes west 78.10 feet; thence north 00 degrees 18 minutes west 224.70 feet; thence north 84 degrees 40 minutes west 64.90 feet; thence south 5 degrees 32 minutes west 75.78 feet to the northerly line of lands dedicated for highway purposes by Document Number 17993033; thence westerly along said northerly line 509.12 feet to the place of beginning. Excepting therefrom that part described as follows: Beginning in the westerly right-of-way line of Elgin, Joliet and Eastern Railroad at a point 400.0 feet northerly from the northerly right- of-way line of public highway as established by instrument of dedication recorded February 5, 1926 as Document Number 9171745 (S.B.I. Route 5); thence westerly, parallel with the northerly line of said highway, a distance of 103.0 feet; thence northerly, parallel with the westerly right-of-way line of the Elgin, Joliet and Eastern Railroad a distance of 10.64 feet; thence easterly, a distance of 102.48 feet to a point on the westerly right-of-way line of the Elgin, Joliet and Eastern Railroad that is 18.28 feet northerly of (measured along said westerly right-of-way line) the point of beginning; thence southerly, along said westerly right-of-way line, a distance of 18.28 feet to the place of beginning; also excepting therefrom that part /I�►• dedicated for highway purposes by Document Numbers 23932825, 11209688 [ and 85031807. Being situated in the City of Elgin, Cook County, Illinois. be and is hereby granted subject to the following conditions: I. Dedication of the eighty (80) foot right-of-way for the realign- ment of Lovell Road in conformance to the Concept Plan prepared by Planning Resources and Opus Corporation dated April 20, 1988 and revised May 26, 1988. Plat of right-of-way dedication to be prepared and recorded by November 24, 1988. 2. Payment of $32,027.83 cash contribution for future improve- ments to Lovell Road. 3. Substantial conformance to the Concept Plan prepared by Planning Resources and Opus Corporation dated April 20, 1988 and revised May 26, 1988. 4. Substantial conformance to on-site traffic recommendations contained in the traffic planning report development by the Metro Transportation Group, Inc., dated May 25, 1988. Section 3.
