HomeMy WebLinkAboutG65-88 Ordinance No. G65-88 AN ORDINANCE AMENDING TITLE 19 ENTITLED "ZONING" OF THE ELGIN MUNICIPAL CODE, 1976, AS AMENDED WHEREAS, written application has been made to amend the provisions of the zoning ordinance to provide for preservation standards; and WHEREAS, the Elgin Planning Committee held a public hearing concerning the proposed amendments after due notice in the manner provided by law; and WHEREAS, the Elgin Planning Committee has submitted its written findings and recommendation that the requested amendments be granted; and WHEREAS, the City Council of the City of Elgin, Illinois, concurs in the findings and recommendations of the Planning Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section I. That Chapter 19.52 of the Elgin Municipal Code, 1976, as amended, be and is hereby amended by adding the following: "1 9.52.050 Standards. No map amendment shall be granted by the City Council unless the following standards are considered: A. Site characteristics including size, shape, topography, drainage, and existing vegetation. B. Surrounding land use and zoning including all property within such proximity as can have an influence on a proposed map amendment. C. Trend of development in the area including any existing or emerging pattern of development comprised of zoning district boundary, use, or bulk considerations. D. Conformance to the Official Comprehensive Plan of Elgin. E. Conformance to a Historic Preservation Plan, as applicable, and conformance to Title 20 - Designation and Preservation of Historically and Architecturally Significant Property, as applicable. F. Suitability of present zoning as determined by site character- istics, surrounding land use and zoning, trend of development in the area, conformance to the Official Comprehensive Plan of Elgin, conformance to a Historic Preservation Plan, as applicable, and conformance to Title 20 - Designation and Preservation of Historically and Architecturally Signifi- cant Property, as applicable." rm. Section 2. That Section 19.48.060 of Chapter 19.48 of the Elgin Municipal Code, 1 976, as amended, be and is hereby amended by adding the following: "D. Will make possible an efficient contemporary use of a designated landmark or property located within a designated historic district while preserving those portions and features of the property, which are signifi- cant due to its historic, architectural, and cultural values pursuant to a Historic Preservation Plan, as applicable, and pursuant to Title 20 - Designation and Preservation of Historically and Architecturally Signifi- cant Property, as applicable." Section 3. That Section 19.50.050 of Chapter 19.50 of the Elgin Municipal Code, 1 976, as amended, be and is hereby amended by adding the following: "H. That the proposed variation will make possible an efficient contemporary use of, or a compatible improvement to a designated land- mark or property located within a designated historic district while preserving those portions and features of the property which are significant to its historic, architectural, and cultural values pursuant to a Historic Preservation Plan, as applicable, and pursuant to Title 20 - Designation and Preservation of Historically and Architecturally Significant Property, as applicable." Section 4. That Section 19.45.070C of Chapter 19.45 of the Elgin Municipal Code, 1976, as amended, be and is hereby amended to read as follows: "C. Variations may be granted by the Land Use Committee within the following limits: signs which would be nonconforming by virtue of their location or other characteristics may be granted a variation if it can be demonstrated that unique physical surroundings, shape, or topographical conditions of the specific property involved would bring a particular hard- ship on the owner, or that no other reasonable alternatives exist which would conform to this chapter, and/or if the public good realized would be greater than that achieved should the strict letter of the regulation be carried out, and if the sign is so designed and located so as to be compat- ible with, and not obstruct the significant architectural features of a designated landmark or property located within a designated historic district pursuant to a Historic Preservation Plan, as applicable, and pursuant to Title 20 - Designation and Preservation of Historically and Architecturally Significant Property, as applicable." Section 5. That Chapter 19.42 of the Elgin Municipal Code, 1976, as amended, be and is hereby amended by adding the following: "19.42.045 Subdivision Regulations--Applicability. Planned unit developments involving a subdivision of land shall comply with Title 18, Subdivisions, unless a departure from the normal procedures, standards, or other requirements is granted as part of the approval process. Planned unit developments not involving a subdivision of land shall comply with Chapter 18.16, Preliminary Plat, of Title 18, Sub- divisions, for the required planned unit development site plan, excepting J a ellbk those requirements specifically applicable only to a subdivision of land. Planned unit developments not involving a subdivision of land shall also comply with Chapter 18.32, Public Use Areas and Public Schools of Title 18, Subdivisions." Section 6.
