HomeMy WebLinkAboutG59-88 Ordinance No. G59-88 AN ORDINANCE REQUIRING SERVERS OF ALCOHOLIC BEVERAGES TO HAVE COMPLETED A BEVERAGE ALCOHOL SELLERS AND SERVERS EDUCATION AND TRAINING PROGRAM WHEREAS, the City of Elgin is a municipal corporation and a home rule unit by virtue of the provisions of the 1970 Constitution of the State of Illinois; and WHEREAS, the City of Elgin may exercise any power and perform any function pertaining to its government and affairs including the power to regulate for the protec- tion of the public health, safety, morals and welfare. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section I. That Chapter 6.06 entitled "Alcoholic Liquor Dealers" of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended by adding Section 6.06.1 15 to read as follows: "6.06.115 BASSET Training Requirements. A. For licenses effective on or after May I, 1990, the original or renewal application for a Class A, AA, B, C, E, F, H and J license shall be accompanied with proof of completion of a state certified Beverage rib Alcohol Sellers and Servers Education and Training Program (BASSET), for all persons who serve or sell alcoholic beverages pursuant to that license. B. After May I, 1990 new employees or managers of a licensee, who are required to complete BASSET training, shall within sixty (60) days from the beginning of their employment with that licensee complete the BASSET program, and shall until completion of the BASSET program work under the supervision of a person who has completed the BASSET program. C. A photocopy of the certificate of completion of the BASSET program must be filed with the City Clerk and maintained in the manager's office on the premises of the licensee." Section 2. That Section 6.06.140 of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended by adding Paragraph S to read as follows: "S. Permit any person in a Class A, AA, B, C, D, E, F, H or J licensed establishment to serve or sell alcoholic beverages unless that person has completed the BASSET training program as required in Section 6.06.115." Section 3. That Section 6.06.120A of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended to read as follows: "A. The local liquor control commmission may revoke or suspend any license or permit issued pursuant to this chapter for cause. In lieu of •• suspension or revocation, the local liquor control commission may impose a fine on the licensee provided such fine shall not exceed one thousand dollars for each violation; each day on which a violation continues or occurs shall constitute a separate violation. Provided further, not more than ten thousand dollars in fines under this chapter may be imposed against any licensee during the period of his license. In addition to other penalties imposed in this chapter, a person violating any regulation of this chapter may be required to again complete a BASSET training program as required in Section 6.06.115." Section 3. That all ordinances or parts of ordinances in conflict with the provi- sions of this ordinance be and are hereby repealed. Section 4.
