AN ORDINANCE
GRANTING A SPECIAL USE FOR A RADIO TRANSMISSION TOWER
WHEREAS, written application has been made for a special use for the establish-
ment, maintenance and operation of a radio transmission tower at I300 Gasket Drive,
Elgin, Illinois; and
WHEREAS, the Land Use Committee conducted a public hearing after due notice
by publication and has submitted its findings of fact and recommended approval; and
WHEREAS, the City Council of the City of Elgin concurs in the findings and
recommendation of the Land Use Committee.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section I. That the City Council of the City of Elgin hereby adopts the findings
of fact made by the Elgin Land Use Committee, a copy of which is attached hereto and
made a part hereof by reference as Exhibit A.
Section 2. That a special use for a radio transmission tower at 1300 Gasket Drive,
Elgin, Illinois, legally described as follows:
Lot 8 in Elgin-Victor Industrial Park Unit Number I, being a part of
the Northeast Quarter of Section 31 and part of the Northwest Quarter of
Section 32, Township 41 North, Range 9 East of the Third Principal
Meridian, according to the plat thereof recorded December 9, 1966 as
Document 20019150, in the City of Elgin, Cook County, Illinois.
be and is hereby granted subject to the following conditions:
I. Substantial conformance to the site plan prepared by World
Tower Co., Inc. and petitioner's Statement.
2. Compliance with all applicable codes and ordinances.
Section 3. That the special use granted herein shall expire if not established
within one year from the date of passage of this ordinance.
Section 4. That this ordinance shall be in full force and effect from and after its
passage in the manner provided by law.

FINDINGS OF FACT
LAND USE COMMITTEE
PLANNING AND LAND USE COMMISSION
CITY OF ELGIN
I. SUBJECT
Consideration of Petition 33-88 Requesting a M-2 General
Manufacturing District Special Use for a Radio Transmission
Tower, property located at 1300 Gasket Drive by the Elgin
Broadcasting Company, as Applicant and the Elgin, Joliet, and
Eastern Railway Company, as Owner.
II. CONSIDERATIONS
A petition has been filed by Attorney John Juergensmeyer on
behalf of Elgin Broadcasting Company which requests a M-2
General Manufacturing District Special Use for a radio
transmission tower. The subject property is located at 1300
Gasket Drive.
Radio Station WJKL (FM) , owned and operated by the Elgin
F Broadcasting Company, desires to relocate its transmitter to
the subject property. Only a portion of the subject property
would be used for this project. The project would consist of
a tower, approximately 366 feet tall, which would stand in the
approximate center of the subject property (the exact height
of the tower being determined by Federal Communications
Commission Rules and Regulations) . A fence, approximately ten
feet by twelve feet, would be erected to fulfill F.C.C.
requirements and to prevent unauthorized entrance. The tower
would be supported by guy wires approximately 180 feet from
the base. The guy wire anchors would occupy approximately a
sixteen square foot area. A windowless structure, about
twelve feet square, would be located at the tower 's base. This
building would house the transmitter, audio processing, and
remote switching equipment. The petitioner is proposing that
this building either be constructed of concrete block, or be a
unit already custom built.
III. FINDINGS
After due notice, as required by law, the Land Use Committee
held a public hearing on the proposed special use for a radio
transmission tower on June 6, 1988. The applicant testified
at the public hearing and presented documentary evidence. No
objectors appeared at the hearing and no written objection has
been filed to the proposed special use .

Exhibit A
The Land Use Committee has made the following findings with
respect to Petition 33-88:
elimk A. Site Characteristics: The subject property is a regularly
shaped parcel containing approximately four acres. The
subject property slopes from south to north with a maximum
relief of fifteen feet, and is undeveloped .
B. Sewer and Water: The subject property can be serviced by
a twelve inch watermain, twelve inch sanitary sewer, and a
thirty inch storm sewer, all of which are located along
Gasket Drive.
C. Traffic and Parking: Gasket Drive is designated as a
minor street designed to serve the Elgin-Victor Industrial
Park. Traffic counts are unavailable for Gasket Drive.
Trip generation information is unavailable for radio
transmission towers.
A minimum of one (1) off-street parking space would be
required for each one and one-half employees on the
premises during any working period, or for each 1 ,000
square feet of floor area, which ever is greater.
D. Zoning History: The subject property was annexed to the
city in 1965, and is zoned M-2 General Manufacturing
District.
(Pk E. Zoning Status: The subject property is a lawful,
conforming General Manufacturing District lot .
F. Surrounding Land Use and Zoning: The areas surrounding
the subject property are zoned M-2 General Manufacturing
District.
The areas to the north and west of the subject property
are currently in agricultural use. Southwest of the
subject property is U.S. Can Company. Directly south of
the subject property, the land is in agricultural use,
with Elgin Sweeper Company located farther south. To the
east lie the Commonwealth Edison high tension wires, the
E.J. and E. Railroad and a mobile home park which is
located in Bartlett.
G. Trend of Development : The subject property is located in
the Elgin-Victor Industrial Park which is being developed
with manufacturing-type uses.
H. Comprehensive Plan: The subject property is designated
"general manufacturing" in the land use component of the
Comprehensive Plan.
I . Special Use Standards: The committee has found that the
proposed special use for a radio transmission tower is in

substantial conformance to the special use standards.
J. Conditions for Approval: The Land Use Committee is of the
`° opinion that the approval of Petition 33-88 should be
subject to the following conditions:
1. Substantial conformance to the site plan and
petitioner 's statement .
2. Compliance with all applicable codes and ordinances.
IV. RECOMMENDATION
On a motion to recommend approval of Petition 33-88, subject
to the conditions for approval, the vote was five (5) yes and
zero (0) no.
Therefore, the Land Use Committee recommends approval of
