HomeMy WebLinkAboutG3-88 Ordinance No. G3-88 AN ORDINANCE AMENDING TITLE 2 AND TITLE 3 OF THE ELGIN MUNICIPAL CODE, 1976, AS AMENDED BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section I. That Title 2, Chapter 2.40 entitled Fire Department of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended by amending Section 2.40.030 to read as follows: 2.40.030 Appointment of members. A. All regular members of the Fire Department, except the chief, deputy chiefs, supervisor of training, superintendent and assistant superintendent of the bureau of inspection services shall be appointed by the board of fire and police commissioners as provided by law. B. The chief of the fire department shall be appointed by the city manager, the deputy chiefs, training supervisor, superintendent and assistant superintendent of the bureau of inspection services shall be appointed by the manager upon the recommendation of the fire chief. If a member of the fire department is appointed chief, deputy chief, training supervisor, superintendent or assistant superintendent of the bureau of inspection services of the fire department prior to being eligible to retire on pension, such member shall be considered as on furlough from the rank held immediately prior to his appointment to any of such positions. If a member resigns or is removed from an exempt rank prior to attaining eligibility to retire on pension, such member shall revert to and be estab- lished in such prior rank, and thereafter shall be entitled and be established in such prior rank, and thereafter shall be entitled to all the benefits and emoluments of such prior rank, without regard as to whether a vacancy then exists in such rank. Section 2. That Title 3, Chapter 3.08 entitled Board of Fire and Police Commis- sioners of the Elgin Municipal Code, 1 976, as amended, be and is hereby further amended by amending Section 3.08.020B to read as follows: B. The fire chief, and the supervisor of training, superintendent of the bureau of inspection services and assistant superintendent of the bureau of inspection services for the fire department and the chief and deputy chiefs of the police department shall be appointed by the city manager and shall be subject to removal by the city manager. Upon expiration of any eligibility list in existence on June 9, 1987 for the position of deputy chief of the fire department, deputy chiefs shall be appointed by the city manager and deputy chiefs shall not be subject to provisions of the Board of Fire and Police Commissioners Act. (III. Rev. Stat., Ch. 24, Division 2, 1985, as amended from time to time.) Section 3. That all ordinances or parts of ordinances in conflict with the provi- sions of this ordinance be and are hereby repealed. Section 4.
