HomeMy WebLinkAboutG28-88 Ordinance No. G28-88 AN ORDINANCE RECLASSIFYING PROPERTY AT RANDALL ROAD, SOUTH STREET AND WELD ROAD WHEREAS, written application has been made to reclassify certain property located at Randall Road, South Street and Weld Road from R-4 General Residence District to B-3 Service Business District and from B-3 Service Business District to R-4 General Residence District; and WHEREAS, the Land Use Committee has conducted a public hearing after due notice and submitted its written findings and recommendations to the City Council; and WHEREAS, the City Council has reviewed the recommendations of the Land Use Committee and concurs in such recommendations. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section I. That Chapter I9.08, Section 19.08.020, entitled "Zoning District Map" of the Elgin Municipal Code, 1976, as amended, be and the same is hereby further amended by adding thereto the following paragraph: "The boundaries hereinbefore laid out in the 'Zoning District Map', as amended, be and are hereby altered by excluding from the R-4 General Residence District and including in the B-3 Service Business District, the following described property: Parcel I That part of that part of the Southwest Quarter of Section 16, and part of the Northwest Quarter of Section 21, Township 41 North, Range 8, East of the Third Principal Meridian, described as follows: Beginning at the intersection of the West line of Edgewood Street, being the West line of Walter G. McIntosh and Company's Fox River Acres, with the North line of South Street, as established by deed recorded February 18, 1965, as Docu- ment 1040511 ; thence West along the North line of South Street 950.48 feet to the Easterly line of Randall Road; thence Northeasterly along said Easterly line which forms an angle of 98 degrees 55 minutes 56 seconds to the right with the prolongation of the last described course, 1733.483 feet to the Southerly right of way line of the U.S. Route 20 Bypass (Federal Aid Route 6) as established by proceedings in the Circuit Court of Kane County, Illinois, as Case No. 60-1166; thence Easterly along said Southerly line which forms an angle of 79 degrees 45 minutes 00 seconds to the right with the prolongation of the last described course, 139.56 feet to an angle in said Southerly line; thence Northeasterly along said Southerly line which forms an angle of 29 degrees 01 minute 36 seconds to the left with the prolongation of the last described course, 336.578 feet to an angle in said Southerly line; thence Northeasterly along said Southerly line which forms an angle of 12 degrees 39 minutes 45 seconds to the right with the prolongation of the last described course, 165.32 feet to an angle in Southerly line; thence Southeasterly along said Southerly line which forms an angle of 25 degrees 19 minutes 30 seconds to the right with the prolongation of the last described course, 151.76 feet to the West line of said Edgewood Street; thence South along said West line 1913.20 feet to the point of beginning, described as follows: Commencing at the intersection of the West line of Edgewood Street, being the West line of Walter G. McIntosh and Company's Fox River Acres, with the North line of South Street, as established by deed recorded February 18, 1965, as Document 1040511 ; thence South 88 degrees 17 minutes 45 seconds West along said North line of South Street, 594.502 feet, more or less, to a point; thence North 0 degree 00 minutes 00 seconds West 328.343 feet to the point of beginning for Parcel I; thence continued North 0 degree 00 minutes 00 seconds West a distance of 42.627 feet; thence North 25 degrees 30 minutes 00 seconds East, a distance of 553.00 feet; thence North 0 degree 00 minutes 00 seconds West, a distance of 900.00 feet, more or less to a point; thence North 32 degrees 02 minutes 51 seconds West, a distance of 80.00 feet to a point in the Southerly right of way line of the U.S. Route 20 Bypass (Federal Aid Route 6) as aforesaid, thence North 57 degrees 57 minutes 09 seconds East along said Southerly right of way line a distance of 107.73 feet; thence North 71 degrees 14 minutes 30 seconds East along said Southerly right of way line a distance of 165.32 feet; thence South 83 degrees 26 minutes 00 seconds East along said Southerly right of way line a distance of 151.76 feet, more or less, to the West line of said Edgewood Street; thence South 0 degree 00 minutes 00 seconds West along said West line a distance of 1527.884 feet more or less, to a point; thence South 82 degrees 50 minutes 22 seconds West, a distance of 598.907 feet to the point of beginning for said Parcel I in the City of Elgin, Kane County, Illinois (said property is located on Weld Road approximately 350 feet East of Randall Road)." Section 2. McIntosh and Company's Fox River Acres, with the North line of South Street, as established by deed recorded February 18, 1965 as Document 1040511 ; thence South 88 degrees 17 minutes 45 seconds West along said North line of South Street, 685.919 feet, more or less to a point; thence North I degree 42 minutes 15 seconds West a distance of 318.53 feet; thence North 82 degrees 50 minutes 22 seconds East, a distance of 101.643 feet to a point; thence South 0 degree 00 minutes 00 seconds West 328.343 feet to a point in the North line of said South Street; thence South 88 degrees 17 minutes 45 seconds West, 91.417 feet to the point of beginning, in the City of Elgin, Kane County, Illinois (said property is located on South Street, approximately 265 feet east of Randall Road)." Section 3.
