HomeMy WebLinkAboutG22-88 d •, Ordinance No. G22-88 AN ORDINANCE AMENDING CHAPTER 6.06 OF THE ELGIN MUNICIPAL CODE, 1976, AS AMENDED WHEREAS, the City of Elgin is an Illinois municipal corporation and a home rule unit pursuant to the Constitution and laws of the State of Illinois; and WHEREAS, a home rule unit may exercise any power and perform any function pertaining to its government and affairs; and WHEREAS, the regulation of the sale of alcoholic liquor is a matter pertaining to the government and affairs of the City of Elgin. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section I. That Chopter 6.06 entitled "Alcoholic Liquor Dealers" of the Elgin Municipal Code, 1976, as amended, be and is further amended by adding Section 6.06.127 as follows: 6.06.127 Posting of notice to minors. All licensed premises within the City shall display at all times in a prominent place a printed sign which shall read substantially as follows: "Warning to persons under the age of 21 You are subject to a fine up to $1,000 pursuant to the City of Elgin Municipal Code if you purchase alcoholic liquor or misrepresent your age for the purpose of obtaining alcoholic liquor if you are under the age of 21 years." Section 2. That Section 6.06.150 of the Elgin Municipal Code, 1976, as amended, is amended by adding Subsection H as follows: H. It is unlawful for any parent or guardian to knowingly permit any person under the age of 21 years of whom he or she may be the parent or guardian to violate any provision of this chapter. In addition, it is unlawful for any person to give, convey, sell, or transfer alcoholic liquor to any person under the age of 21. Provided, nothing herein shall apply to con- sumption or possession of alcoholic liquor by a minor as permitted pursuant to Section 6-20 of the Illinois Liquor Control Act of 1934. (III. Rev. Stat., Ch. 43, s134(a)) Section 3. That Chapter 6.06 entitled "Alcoholic Liquor Dealers" of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended by adding Sec- tion 6.06.135 as follows: • 6.06.135 Sanitary and health conditions. a. All premises used for the retail sale of alcoholic liquor, or for the storage of such liquor for such sale, shall be kept in full compliance with the provisions of this code regulating the conditions of permises used for storage or sale of food for human consumption. b. It shall be unlawful to employ in any premises used for the retail sale of alcoholic liquor any person who is afflicted or who is a carrier of any contagious, infectious or venereal disease; and it shall be unlawful for any person who is afflicted with or a carrier of any such disease to work in or about any premises or to engage in any way in the handling, preparation or distribution of such liquor. Section 4. That Section 6.06.040(B) of the Elgin Municipal Code, 1976, as amended, is hereby amended to read as follows: B. Class AA. For the retail sale, on the premises specified, of alcoholic liquors primarily for consumption on the premises as well as other incidental retail sales of such alcoholic liquors which include sales by original package, one thousand five hundred dollars. Section 5. That all ordinances or ports of ordinances in conflict with the provi- sions of this ordinance be and are hereby repealed. Section 6.
