AN ORDINANCE
CLASSIFYING CERTAIN NEWLY ANNEXED TERRITORY AND GRANTING
A SPECIAL USE FOR A TRANSPORTATION FACILITY
(State Route 31)
WHEREAS, the territory herein described has been annexed to the City of Elgin;
and
WHEREAS, written application has been made to classify said territory in the M-I
Limited Manufacturing District; and
WHEREAS, after due notice in the manner provided by law the Land Use
Committee conducted a public hearing concerning said application and has submitted its
written findings and recommendation; and
WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings
and recommendations of the Land Use Committee and concurs in its recommendation.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section I. That Chapter 1 9.08, Section 19.08.020, entitled "Zoning District Map"
of the Elgin Municipal Code, 1976, as amended, be and the same is hereby further
amended by adding thereto the following paragraph:
"The boundaries hereinbefore laid out in the 'Zoning District Map', as
amended, be and are hereby altered by including in the M-1 Limited
Manufacturing District, the following described property:
Commencing at the Northeast Corner of the Northeast Quarter of
said Section 26; thence South along the East line of said Northeast Quarter,
983.4 feet to the South line of the land conveyed to the State of Illinois by
deed dated April 12, 1871 and recorded April 18, 1871 in Book 131, Page 73;
thence West 1,244.9 feet along said South line to the Easterly right-of-way
line of Illinois Route 31; thence Southwesterly 78.4 feet along said right-of-
way line to a point on a line 66.0 feet South of and parallel with said South
line of land conveyed to the State of Illinois; thence East 480.48 feet along
said parallel line to the point of beginning; thence Southwesterly 770.87
feet at an angle of 62° 32' 52", measured counterclockwise from the last
described course, to the most Northerly line of land described in Document
No. 32303, recorded September 29, 1890; thence Westerly along said North-
erly line 524.28 feet; thence Northeasterly 262.34 feet at an angle of 52°
54' 10", measured counterclockwise from the last described course; thence
Northwesterly 123.22 feet at an angle of 62° 30' 00", measured clockwise
from the last described course, to the Easterly right-of-way line of Illinois
Route 31; thence Northeasterly 563.04 feet along said right-of-way line to
a point on a line 66.0 feet South of and parallel with said South line of land
conveyed to the State of Illinois by deed recorded in Book 131, Page 73;
/!� thence East 489.11 feet along said South line to the point of beginning."

Section 2. That the City Council of the City of Elgin hereby adopts the findings
of fact made by the Elgin Land Use Committee, a copy of which is attached hereto as
Exhibit A and incorporated herein by reference.
Section 3. That a special use permit for the use of the subject property as a
transportation facility is hereby granted subject to the following terms and conditions:
I. Substantial conformance to the site plan prepared by Legat
Architects dated February, 1987.
2. Compliance with all other applicable codes and ordinances.
Section 4. That this ordinance shall be in full force and effect from and after its
passage and approval in the manner provided by law and shall be published in pamphlet
form by authority of the City Council.
