AN ORDINANCE
AUTHORIZING THE ACQUISITION OF CERTAIN PROPERTY FOR
THE IMPROVEMENT OF SOUTH McLEAN BOULEVARD
WHEREAS, the City Council of the City of Elgin has determined that it is
necessary and desirable to widen and improve South McLean Boulevard, a public roadway
in the City of Elgin; and
WHEREAS, in order to widen and improve said roadway it is necessary to acquire
certain real property hereinafter described; and
WHEREAS, the City of Elgin is a home rule unit authorized to exercise any power
and perform any function relating to its government and affairs; and
WHEREAS, the widening and improving of public roadways is within the govern-
ment and affairs of the City of Elgin.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section I. That it is hereby determined that certain real property in the City of
Elgin, Kane County, Illinois, hereinafter described, be acquired for the purpose of widen-
ing and improving a public roadway for the benefit of the public.
Section 2. That it is hereby determined that it is necessary and desirable that the
City of Elgin shall acquire title to and possession of the following described real
property, which is necessary, required and needed for the purpose of widening and
improving South McLean Boulevard, lying wholly within the limits of the City of Elgin, to
wit:
Parcel 001
That part of the South Half of Section 22, Township 41 North, Range 8 East
of the Third Principal Meridian, described as follows: Commencing at the
intersection of the South line of Section 22, Township 41 North, Range 8 East
of the Third Principal Meridian and the centerline of McLean Boulevard; thence
Northerly along the centerline of McLean Boulevard, 302.14 feet to the Point
of Beginning; thence Easterly, parallel to the South line of Section 22 on an
assumed bearing of North 89 degrees 22 minutes 52 seconds East to a point 50.00
feet East of the centerline of McLean Boulevard, as measured at right angles;
thence North 6 degrees 20 minutes 52 seconds East, 763.83 feet, parallel with
the centerline of McLean Boulevard; thence Northerly 316.85 feet along a
tangential curve concave to the East, radius 4,143.46 feet, central angle
4 degrees 22 minutes 53 seconds, parallel to the centerline of McLean Boulevard;
thence North 56 degrees 19 minutes 50 seconds East, 35.09 feet; thence South
-78 degrees 55 minutes 45 seconds East, 30.00 feet; thence North 11 degrees

88 degrees 54 minutes 09 seconds West, 51.85 feet to a point on the centerline
of McLean Boulevard; thence Southerly 574.23 feet along the centerline of McLean
Boulevard, said centerline being a curve concave to the East, radius 4,193.46

20 minutes 52 seconds West, 769.94 feet, along the centerline of McLean
Boulevard to the Point of Beginning, containing in all 72,153 square feet, more
or less, 44,345 square feet of which was previously used for highway purposes.

intersection of the Northerly right-of-way line of Spartan Drive extended Easterly
and the centerline of McLean Boulevard; thence Westerly 40.04 feet along said
Northerly right-of-way line of Spartan Drive on an assumed bearing of North 80
degrees 30 minutes 25 seconds West to a point on a 4,233.46 foot radius curve,
the center of circle of said curve bears South 78 degrees 06 minutes 36 seconds
East from said point; thence Northerly along said curve 49.97 feet, central angle
0 degrees 40 minutes 35 seconds, parallel to the centerline of McLean Boulevard;

Section 3. That James J. Cook, City Manager of the City of Elgin, and James H.
Driessen of Universal Consultants, Ltd., be and are hereby authorized, empowered and
directed to negotiate for and on behalf of the City of Elgin with the owner or owners of
the above described real properties for the purchase of the real property described by the
City of Elgin.

Section 5. In the event that the City Manager and James H. Driessen are unable
to agree with the owner or owners of said properties as to compensation to be paid
therefor, in accordance with the provisions of this ordinance, then title to and possession
of said properties shall be acquired by the City of Elgin in accordance with the laws of
rik the eminent domain of the State of Illinois, and the Corporation Counsel is hereby
authorized, empowered and directed to institute appropriate proceedings in any court of
competent jurisdiction to acquire title to and possession of said property for the City of
Elgin in accordance with the eminent domain laws of the State of Illinois.
