AN ORDINANCE
GRANTING A SPECIAL USE FOR A DAY CARE CENTER
WHEREAS, written application has been made for a special use for the establish-
ment, maintenance and operation of a day care center at 325, 331, 337 and 343 Lilac
Lane; and
WHEREAS, the Land Use Committee conducted a public hearing after due notice
by publication and has submitted its findings of fact and recommended approval; and
WHEREAS, the City Council of the City of Elgin concurs in the findings and
recommendation of the Land Use Committee.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section I. That the City Council of the City of Elgin hereby adopts the findings
of fact made by the Elgin Land Use Committee, a copy of which is attached hereto and
made a part hereof by reference as Exhibit A.
Section 2. That a special use for a day care center at 325, 331, 337 and 343 Lilac
Lane, Elgin, Illinois, legally described as follows:
Lots 39, 40, 41 and 42 of Town and Country Manor, being a subdivi-
sion of part of the Northwest Quarter of Section 22, Township 41 North,
Range 8 East of the Third Principal Meridian in the City of Elgin, Kane
County, Illinois.
be and is hereby granted subject to the following conditions:
I. Conformance with the site plan prepared by Schaffer-Bonavolonta
Architects, Inc., dated April 26, 1985.
2. Conformance with all other applicable city codes and ordinances,
and state statutes.
Section 3. That this ordinance shall be in full force and effect from and after its
passage in the manner provided by law.

I. SUBJECT
Consideration of Petition 29-85 Requesting an "0" Limited
Office District Special Use for a Day Care Center, property
located at 325, 331 , 337 and 343 Lilac Lane by Kinder Care
Learning Centers, Inc.
II . CONSIDERATIONS
A petition has been filed by Mr. Anthony Bonavolonta on behalf
of Kinder Care Learning Centers, Inc . that requests an "0"
district special use for a day care center. The subject
property is located at 324, 331 , 337 and 343 Lilac Lane.
Kinder Care Learning Centers, Inc . desires to locate a second
day care center in Elgin . The proposed day care center will
be licensed for one hundred twenty-three ( 123) children. The maximum number of employees to be at the center at any given
time is eight (8) .
III . FINDINGS AND RECOMMENDATION
After due notice as required by law, the Land Use Committee
held a public hearing on the proposed special use for a day
care center on June 17, 1985. The petitioner appeared at the
hearing and presented documentary evidence . An objector
appeared at the hearing, but no written objection has been
filed to the proposed special use
A . Site Characteristics : The subject property is
approximately 40,080 square feet . The property is
unimproved .
B. Zoning History: The subject property has been zoned "0"
Limited Office District since 1978.
C. Surrounding Land Use and Zoning: The area located to the
north of the subject property is zoned "0" and B-3. The
area is largely undeveloped, except for one (1 ) office
building located adjacent to the subject property .
Town and Country Shopping Center is located to the east of
the subject property and is zoned B-3.
U. S. Route 20 is located to the south of the subject
property .

The area located to the west of the subject property is
zoned R-4 and is developed with apartment .
e'' D. Public Convenience : The day care center is acceptable for
the public convenience at the proposed location in that
the proposed use is compatible with surrounding land uses
and in that the subject property has adequate space for
safe and efficient off-street parking.
E. Public Health, . Safety and Welfare : The day care center
will be so designed , located and operated that the public
health, safety and welfare will be protected because of
the specific conditions to be imposed on the special use
and in that these conditions promote the use of the
subject property in a manner compatible with surrounding
property .
F. Value of Other Property : The day care center will not
cause substantial injury to the value of other property in
the area in which it is located because the conditions to
be imposed on the special use promote the use of the
subject property in a manner compatible with surrounding
property .
G. Additional Conditions : The Land Use Committee is of the
opinion that special use approval should be subject to the
following conditions :
1 . Conformance to the site plan prepared by
Schaffer-Bonavolonta Architects , Inc . , dated April 26 ,
1985.
2. Conformance to all other applicable city codes and
ordinances, and state statutes .
Accordingly , on a motion to recommend approval of Petition 29-85,
subject to the additional conditions , the vote was five (5) yes ,
zero (0) no , and one ( 1 ) abstention.
Therefore , the Land Use Committe recommends approval of Petition
29-85.
