HomeMy WebLinkAboutG56-85 R 3 rbk Ordinance No. G56-85 AN ORDINANCE AMENDING AN ORDINANCE CLASSIFYING CERTAIN NEWLY ANNEXED TERRITORY TO THE CITY OF ELGIN AND GRANTING A SPECIAL USE FOR A PLANNED UNIT DEVELOPMENT WHEREAS, Ordinance No. G81-78, passed December 13, 1978, classified and granted a special use for a planned unit development to develop a residential/commercial project upon certain property legally described below; and WHEREAS, written application has been made to amend the special use for a residential/commercial planned unit development with respect to the undeveloped residential portion of said project; and WHEREAS, the Land Use Committee conducted a public hearing after due notice in the manner required by law and has recommended granting the amendment requested; and WHEREAS, the City Council of the City of Elgin has reviewed the findings and recommendations of the Land Use Committee and concurs in the amendment of the special use as requested. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Ordinance No. G81-78, passed December 13, 1978, classifying and granting a special use for a planned unit development for a residential/commercial project upon the following legally described territory: That part of Sections 17, 19 and 20, Township 41 North, Range 9 East of the Third Principal Meridian described as follows: Beginning at the Northwest corner of said Section 20; thence North 00° 33' 59" East along the West line of Section 17, 26.70 feet (measured and deed) to a point on the Southerly right-of-way line of State Route 19; thence South 73 37' 30" East, along the Southerly right-of-way line of State Route 19, 463.65 feet (measured and deed) to a point of curvature; thence Southeasterly along a curve to the left, also being the Southerly right-of-way line of State Route 19, having a radius of 1,795.23 feet, an arc distance of 184.53 feet measured 187.40 feet deed (the chord thereof bearing South 73° 16' 05" East, 184.45 feet measured, 187.32 feet deed) to the Northwest corner of Leo Leichter property; thence South 08° 56' 47" West 4133.02 feet measured and deed; thence South 83° 39' 09" East 1001.22 feet measured and deed, to a point on the centerline of Lovell Road; thence South 05° 59' 38" West, along said centerline of Lovell Road 2577.85 feet measured (2,530.89 feet deed) to a point on the North right-of-way line of U.S. Route 20; thence North 56° 47' 58" West., 205.25 feet measured and deed, along the Northerly right-of-way line U.S. Route 20; thence North 37° 20' 58" West, 272.85 feet measured (275.14 feet deed); thence North 42° 49' 34" West 520.22 feet measured (518.89 feet deed); thence North 62° 51' 12" """` West, 182.61 feet measured (182.72 feet deed); thence North 64° 46' 29" West, 386.13 feet measured (385.88 feet deed); thence North 81° 49' 35" West, 253.21 feet measured (251.62 feet deed); thence South 81° 42' 50" West, 522.77 feet measured (524.74 feet deed); thence South 73° 08' 31" West, 220.42 feet measured and deed; thence North 53° 00' 29" West, also being the North right-of-way line of U.S. Route 20, 507.48 feet measured (505.00 feet deed); thence North 56° 01' 18" West, 902.64 feet measured (906.19 feet deed); to the Southeast corner of Lot 4 of County Clerk's Division of unsubdivided land in said Section 19; thence North 10° 04' 53" East, 680.07 feet measured (679.82 feet deed) to the South line of School District U-46; thence South 88° 43' 03" East, along the Southerly line of said School District U-46, 1873.83 feet measured (1,875.72 feet deed); thence North 01° 28' 42" East, 1,268.36 feet measured (1,269.85 feet deed); thence North 63° 54' 45" East, 200.00 feet measured and deed, to a point on the West line of Section 20; thence North 00° 33' 59" East, along said West line of Section 20, 598.39 feet (593.40 feet deed) to the place of beginning. is hereby amended as follows: A. "The boundaries hereinbefore laid out in the 'Zoning District Map', as amended, be and are hereby altered by excluding from the R-2 Single Family Residence District, and including in the R-3 Two Family Residence District, the following described property: That part of Sections 19 and 20, Township 41 North, Range 9 East of the Third Principal Meridian described as follows: Commencing at the tow Northeast corner of said Section 19; thence South 00° 33' 59" West along the East line of said Section 19 for a distance of 598.39 feet; thence South 63° 54' 45" West for a distance of 200.00 feet; thence South 01° 28' 42" West for a distance of 1268.36 feet to the point on the South line of School District U-46, said point also being the point of beginning; thence Easterly along a curve having a radius of 600 feet concave Northerly, for a distance of 163.59 feet; thence South 14° 20' 22" East for a distance of 153.32 feet; thence South 00° East for a distance of 350.00 feet; thence South 33° 03' 42" East for a distance of 498.65 feet; thence South 04° 46' 29" East for a distance of 100.00 feet; thence South 25° 13' 31" West for a distance of 115.00 feet; thence North 84° 46' 29" West for a distance of 50.00 feet; thence South 25° 13' 31" West for a distance of 155.00 feet; thence North- westerly along a curve, concave Southwesterly, having a radius of 824.25 feet, for a distance of 539.58 feet; thence South 81° 42' 50" West for a distance of 270.00 feet; thence North 08° 17' 10" West for a distance of 160.0 feet; thence South 81° 42' 50" West for a distance of 295.00 feet; thence North 53° 00' 29" West for a distance of 404.66 feet; thence North 34° 27' 11" East for a distance of 375.00; thence North 55° 32' 49" West for a distance of 160.00 feet; thence North 34° 27' II" East for a distance of 240.00 feet; thence South 55° 32' 49" East for a distance of 160.00 feet; thence North 44° 27' II" for a distance of 110.00 feet; thence North 18° 13' 20" for a distance of 141.09 feet; thence North 00° East for a distance of 125.00 feet to a point on the South line of said U-46 School District; thence South 88° 43' 04" East along said South line of U-46 School District for a distance of 643.83 feet to the point of beginning, in Cook County, Illinois, containing 31.2 acres more or less." B. That the City Council of the City of Elgin, Illinois, hereby finds and deter- mines that the development of the territory heretofore described as a planned unit development substantially as depicted on a preliminary plan prepared by Wm. A. Dean, dated June 27, 1978 and revised September 23, 1984 and a preliminary engineering plan prepared by Christian-Roge & Ribando, dated December 19, 1984, which are attached hereto and etude G part hereof by reference as Exhibits A and B, and subject to the conditions of the Second Amendment to Annexation Agreement between City of Elgin, LaSalle National Bank, as Trustee under Trust No. 53570 and Not Personally, and U.S. Shelter, Inc., dated May 13, 1985." Section 2. That the provisions of Ordinance No. G81-78, passed December 13, 1978, be and are hereby modified with respect to the undeveloped residential portion of the planned unit development authorized herein as provided above. Section 3.
