HomeMy WebLinkAboutG55-85 Ordinance No. G55-85 AN ORDINANCE GRANTING A SPECIAL USE FOR OFF-STREET PARKING AT 615 SLADE AVENUE WHEREAS, written application has been made for a special use for the establish- ment, maintenance and operation of an off-street parking lot at 615 Slade Avenue; and WHEREAS, the Land Use Committee conducted a public hearing after due notice by publication and has submitted its findings of fact and recommended approval; and WHEREAS, the City Council of the City of Elgin concurs in the findings and recommendation of the Land Use Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section I. That the City Council of the City of Elgin hereby adopts the findings of fact made by the Elgin Land Use Committee, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. Section 2. That a special use for an off-street parking lot at 615 Slade Avenue, Elgin, Illinois, legally described as follows: Lot 9 in Block 2 of Robert B. Maule's Subdivision of the East 336 feet of Block 2 and all of Block 3 of Fair Lawn Addition to Elgin, in the City of Elgin, Kane County, Illinois. be and is hereby granted subject to the following conditions: I. Substantial conformance to the Preliminary Site Plan. 2. A four foot landscaping screen on the side adjoining residential lots. 3. Compliance with all other applicable codes and ordinances. Background A petition has been filed by Mr . James G. La Sanka requesting an R-2 special use for off-street parking . The subject property is located at 615 Slade Avenue (see -Page 1- C') H 4 Exhibits A and B) . The petitioner intends to sell the subject property and the two ( 2) lots to the immediate west thereof . The prospective purchaser of the property proposes to establish a carry-out restaurant at the southeast corner of Slade Avenue and North Liberty Street . The purchaser must acquire the subject property in order to provide the required number of off-street parking spaces for the restaurant use (see Exhibit C) . B. Site Characteristics The subject property is a regularly shaped lot of approximately 6, 402 square feet (48. 5 x 132) . The property is undeveloped . C. Zoning History 1927 G-Ind . 1960 F-Ind . 1962 R-2 1950 F-Ind . 1961 F-Ind. Present R-2 D. Surrounding Land Use and Zoning The areas located to the northwest , north and northeast of the subject property are zoned B-1 , B-4 and M-1 . These areas are developed with various commercial and office uses . The areas located to the east and southeast of the subject property are zoned R-2 and developed with single family residences . The areas located to the south and west of the subject property are zoned B-3 and M-1 . These areas are developed with a printing establishment , an advertising agency and various manufacturing uses . V. FINDINGS AND RECOMMENDATION The Planning Department recommends approval of Petition 28-85. The department has made the following findings with respect to the requested special use : 1 . The off-street parking lot is acceptable for the public convenience at the proposed location in that it is needed for the redevelopment of an underutilized commercial site; 2 . The off-street parking lot will be so designed , located and operated that the public health, safety and welfare (6' will be protected because of the specific conditions to be imposed on the special use and in that these conditions promote the use of the subject property in a manner -Page 2- compatible with surrounding property ; and 3. The off-street parking lot will not cause substantial injury to the value of other property in the neighborhood in which it is located because of the specific conditions to be imposed on the special use and in that the proposed use is compatible with the surrounding commercial and residential land uses . The Planning Department is of the opinion that approval of Petition 28-85 should be subject to the following conditions : 1 . Substantial conformance to the Preliminary Site Plan (Exhibit C) ; and 2 . Compliance with all other applicable codes and ordinances . IV. ACTION TAKEN At its regular meeting of June 3, 1985 , the Land Use Committee recommended approval of the special use , subject to the three (3) additional conditions , by a vote of six (6) yes and zero (0) no (see Exhibits E and F) .
