HomeMy WebLinkAboutG23-85 f Ordinance No. 23-85 AN ORDINANCE GRANTING A SPECIAL USE FOR AN OFF-STREET PARKING LOT WHEREAS, written application has been made for a special use for the establish- ment, maintenance and operation of an off-street parking lot at the northwest corner of South Liberty Street and May Street; and WHEREAS, the Land Use Committee conducted a public hearing after due notice by publication and has submitted its findings of fact and recommended approval; and WHEREAS, the City Council of the City of Elgin concurs in the findings and recommendation of the Land Use Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section I. That the City Council of the City of Elgin hereby adopts the findings of fact made by the Elgin Land Use Committee, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. Section 2. That a special use for an off-street parking lot at the northwest corner of South Liberty Street and May Street, Elgin, Illinois, legally described as follows: Lot 23 of Block I of Wallin's Addition to the City of Elgin, Elgin Township, Kane County, Illinois. be and is hereby granted subject to the following conditions: I. Access for the off-street parking lot shall be limited to May Street. 2. Compliance with all applicable codes, ordinances and statutes. Section 3. SUBJECT Consideration of Petition 3-85 Requesting an R-3 Two Family Residence District Special Use for Off-street Parking, property located at the Northwest Corner of South Liberty and May Streets by Calvary Baptist Church. II. CONSIDERATIONS A petition has been filed by Calvary Baptist Church that requests an R-3 special use for an off-street parking lot. The subject property is located at the northwest corner of South Liberty and May Streets. The Calvary Baptist Church desires to develop the subject property with off- street parking, thereby relieving some conflicts created by their present use of on-street parking. rft III. FINDINGS AND RECOMMENDATION After due notice, as required by law, the Land Use Committee held a public hearing on the proposed special use for off-street parking on January 21, 1985. The petitioner appeared at the hearing and presented documentary evidence. Objectors appealed but no written objection has been filed to the proposed special use for off-street parking. The Land Use Committee has made the following findings with respect to the requested special use: A. Site Characteristics: The subject property is a regularly shaped lot of approximately 8,712 square feet (66 x 132) . The property is presently undeveloped. B. Zoning History: 1927 A-Res. 1960 B-Res. 1962 R-3 1950 B-Res. 1961 B-Res. Present R-3 C. Surrounding Land Use and Zoning: The subject property is located within an R-3 district that is developed predominantly with single family residences and interspersed with two unit conversions. Calvary Baptist Church is located immediately west of the subject property. Garfield Elementary School is located southwest of the subject property. Public Convenience: The off-street parking lot is acceptable for the public convenience at the proposed location in that it will relieve an existing shortage of parking spaces and in that the subject property is suitable for the construction of an off-street parking lot. E. Public Health, Safety and Welfare: The off-street parking lot will be so designed, located and operated that the public health, safety and welfare will be protected because of the specific conditions to be im- posed on the special use and in that these conditions promote the use of the subject property in a manner compatible with surrounding property. F. Value of Other Property: The off-street parking lot will not cause sub- stantial injury to the value of other property in the neighborhood in which it is located because of the specific requirements to be imposed on the special use and in that the proposed use is compatible with the low surrounding residential and community service facility land uses. G. Additional Conditions: The Land Use Committee is of the opinion that Petition 3-85 should be subject to the following conditions: 1. Access for the off-street parking lot is to be limited to May Street; and 2. Compliance with all applicable codes, ordinances and statutes. Accordingly, on a motion to recommend approval of Petition 3-85, subject to the additional conditions, the vote was five (5) yes and zero (0) no. During our church services we use the off street parking along May St. and Liberty and Arlington Ave. We have struggled to keep our people aware of the no parking areas located across from the fire station on Arlington. However, it has been difficult during snow and fallen leaves to determine what the no parking areas are. Due to the abo'. e mentioned parking problems we consider it a blessing to have this property offered to us. We will be using this property as a parking lot alone. Exhibit C
