____ Ordinance No. G22-85 AN ORDINANCE GRANTING A SPECIAL USE FOR AN AMUSEMENT ESTABLISHMENT WHEREAS, written application has been made for a special use for the establish- ment, maintenance and operation of an amusement establishment at 13 Douglas Avenue; and WHEREAS, the Land Use Committee conducted a public hearing after due notice by publication and has submitted its findings of fact and recommended approval; and WHEREAS, the City Council of the City of Elgin concurs in the findings and recommendation of the Land Use Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section I. That the City Council of the City of Elgin hereby adopts the findings of fact made by the Elgin Land Use Committee, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. Section 2. That a special use for an amusement establishment at 13 Douglas Avenue, Elgin, Illinois, legally described as follows: The Southerly 43.5 feet of Lots 4 and 5 in Block 16 of James T. Gifford's Plat in the City of Elgin, Kane County, Illinois. be and is hereby granted subject to the following conditions: I. Conformance with the terms and conditions stated in the proposal for a teen nightclub, prepared by Richard A. Beyers. 2. Patrons shall be charged a separate admission fee each time they seek to enter the premises. 3. Compliance with all applicable codes and ordinances. Section 3. SUBJECT Consideration of Petition 11-85 Requesting a B-2 Central Business District Special Use for an Amusement Establishment, property located at 13 Douglas Avenue by Mr. Ben Corn. II . CONSIDERATIONS A petition has been filed by Mr. Ben Corn that requests a B-2 special use for an amusement establishment . The subject property is located at 13 Douglas Avenue . The petitioner desires to lease the basement level of his building to a tenant who intends to operate a "teen nightclub" from the premises . III . FINDINGS AND RECOMMENDATION After due notice as required by lae, the Land Use Committee held a public hearing on the proposed special use for an tiek amusement establishment on February 25, 1985. The petitioner appeared at the hearing and presented documentary evidence. An objector appeared , but no written objection has been filed to the proposed special use . A majority of the Land Use Committee has made the following findings with respect to the requested special use: A. Site Characteristics : The subject property is approximately 5, 035 square feet and is improved with a three story commercial building. The basement level of the building, formerly occupied by a restaurant, is in general compliance with building code requirements for the proposed use. B. Zoning History: 1927 F-Comm. 1960 E-Comm. 1962 B-2 1950 E-Comm. 1961 E-Comm. Present B-2 C. Surrounding Land Use and Zoning: The subject property is located within the central business district (CBD) and is zoned B-2. Surrounding land uses include commercial uses, Exhibit A -Page 1- F offices and a restaurant. The civic center complex is located to the northwest of the subject property . D. Trend of Development : The area in which the subject property is located , and Fountain Square Plaza comprise the mixed retail and commercial service core in the CBD. In recent • years, retail activities locating in the CBD have concentrated along Douglas Avenue and Chicago Street . E. Comprehensive Plan : The following is a summary of the relevent findings and policies of the comprehensive plan: 1 . The subject property is located within the CBD as it is portrayed on the land use map. This land use category represents "downtown" Elgin. The CBD should function as a multi-use center containing retail , commercial services, offices, entertainment , institutions, governmental , educational and residential land uses. 2 . The Central Business District Plan recommends goals and policies for effectuating revitalization of the CBD. The plan serves as a guide for land use decisions and, as such , is a policy statement in and of itself. The subject property is located in an area designated mixed retail-commmercial services on the land use concept plan. This area contains , and should continue to contain a variety of commercial service and retail activities . Ground level space within this area should be limited to uses that are retail or service oriented, or are complementary with these types of activities, such as restaurants and entertainment establishments. F. Public Convenience : The teen nightclub is acceptable for the public convenience at the proposed located in that the use is consistent with surrounding land uses, and in view of the findings of the Central Business District Plan. G. Public Health , Safety and Welfare: The teen nightclub will be so designed , located and operated that the public health, safety and welfare will be protected because of the specific requirements of the B-2 Central Business District and because of the additional conditions to be imposed on the special use . H. Value of Other Property: The teen nightclub will not cause substantial injury to the value of other property in the area in which it is located because of the specific conditions to be imposed on the special use and in that the teen nightclub is to be located within the central business district. I . Additional Conditions: The committee is of the opinion that special use approval should be subject to the following -Page 2- PROPOSAL FOR A TEN NIGHT^LUB To be located at: Lower Level 13 Douglas Avenue Elgin. Illinois 1. Business will be open only four nights a w'ek - Thursday. Friday, Saturday and Sunday. 2. Hours will be Thursday and Sunday - 7 to 12 and Friday and Saturday - 7 - 1 . 3. Admission fee will be 33.00 or $4.00• 4. Employees - 5 or 6 adult employees. 5 . Security - At least 1 uniformed off-duty police officer at all times . 6 . Refreshments - only soft drinks will be served - 4 to 5 different brands . At this time there will be no charge for refreshments . 7 . .ntertainment will consist of a professional sound system - records and tape only . Live music is not planned at this time. 8 . Dancing . There will be two dance floors with a total of 1300 sq . ft . to accommodate approximately 200 dancers . 9. Seating . Booths . tables and chairs for approximately 150 people . 10. Game room. At this time 8 to 10 games are planned for the game room. 11. Exits . There are 3 exits all leading directly outside . 12 . Fire protection. Complete sprinkler system in ceiling .
