HomeMy WebLinkAboutG63-84 Ordinance No. G63-84 AN ORDINANCE DESIGNATING AN ENTERPRISE ZONE UNDER THE ILLINOIS ENTERPRISE ZONE ACT WHEREAS, the State of Illinois has passed legislation providing for the establishment of enterprise zones under the Illinois Enterprise Zone Act (Public Act 82-1019); and WHEREAS, Section 2 of said Act provides as follows: The General Assembly finds and declares that the health, safety and welfare of the people of this State are dependent upon a healthy economy and vibrant communities; that the continual encouragement, development, growth and expansion of the private sector within the State requires a cooperative and continuous partnership between government and the private sector; and that there are certain depressed areas in the State that need the particular attention of government, business, labor and the citizens of Illinois to help attract private sector investment into these areas and directly aid the local community and its residents. Therefore, it is declared to be the purpose of this Act to explore ways and means of stimulating business and industrial growth and retention in depressed areas of the State by means of relaxed government controls and tax incentives in those areas. and WHEREAS, included within the City of Elgin is an area greater than one-half square mile and less than ten square miles more fully described below; and WHEREAS, the aforesaid area is subject to and is experiencing economic depression including pervasive poverty, unemployment and economic distress; and WHEREAS, the City of Elgin conducted a public hearing concerning the designation of the area described above as an enterprise zone, after due notice in the manner provided by law; and WHEREAS, the City of Elgin has determined that the area described is a depressed area requiring a stimulation of business and industrial growth and retention and that the provision of certain State and local incentives will contribute to the encouragement of construction of new commercial and industrial improvements and the rehabilitation of existing structures and increase employment opportunities by attracting and encouraging private sector investment thereby aiding the City of Elgin and its residents including those located within the area described. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section I. That the City Council of the City of Elgin hereby finds and determines that the area described below: and (a) is a contiguous area located entirely within the City of Elgin; (b) comprises a minimum of one-half square miles and not more than ten square miles in total area, exclusive of lakes and waterways; and (c) is a depressed area; and (d) is an area of low income household concentration as determined through analysis of the 1980 federal census; and (e) is an area of the City which has experienced an average unemployment rate of 190% of the average statewide unemployment rate, for the twelve month period ending June 30, 1984 as derived from reports by the Illinois Department of Labor, Bureau of Employment Security, Research and Development Section. Section 2. That the City Council of the City of Elgin hereby finds and determines that the area described below meets the qualifications of Section 4 of the Illinois Enterprise Zone Act. Section 3. That the territory described in Exhibit A attached hereto and located wholly within the City of Elgin be and is hereby designated as an enterprise zone. Section 4. That the term of the enterprise zone designated herein shall be for a period of ten years after certification by the Illinois State Department of Commerce and Community Affairs as provided by law. Section S. That the City Manager is hereby authorized and directed to cause to be prepared and to execute and file an application with the Illinois State Department of Commerce and Community Affairs in accordance with the provisions of the Illinois Enterprise Zone Act and to provide such additional information and documents as may be required by the Department and to otherwise take such action as may be required by the Department and to otherwise take such action as may be necessary on behalf of the City of Elgin to obtain certification by the Department of the enterprise zone herein established.
