AN ORDINANCE
AMENDING THE PROVISIONS OF CHAPTER 3.40 PROVIDING FOR THE
ESTABLISHMENT OF A BOARD OF LOCAL IMPROVEMENTS
WHEREAS, the City of Elgin is a home rule unit within the meaning of
Article VII of the Constitution of the State of Illinois, 1970; and
WHEREAS, by virtue of the authority of the provisions of Article VII
of the Constitution of the State of Illinois, 1970, the City of Elgin, as
a home rule unit, is authorized to exercise any power and perform any func-
tion pertaining to its government and affairs; and
WHEREAS, the organization of boards and commissions to assist in the
carrying out of the powers of the City of Elgin is within the government
and affairs of the City of Elgin.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That Section 3.40.010 of Chapter 3.40 of the Elgin Municipal
Code, 1976, as amended, is hereby amended to read as follows:
"3.40.010 Created
There is hereby established a Board of Local Improvements
for the City of Elgin which shall consist of the Mayor and
members of the City Council. The Mayor shall serve as President
of the Board of Local Improvements.
The Board of Local Improvements shall meet at such times
as it may determine, or upon call of the President thereof, and
shall have the powers and duties provided for in Article 9, of
Chapter 24, Illinois Revised Statutes, 1979, as amended from
time to time."
Section 2. That there is hereby added to Chapter 3.40 of the Elgin
Municipal Code, 1976, as amended, the following:
"3.40.020 Duties
Insofar as they may pertain to the activities of the Board
of Local Improvements, the functions of the Commissioner of Public
Works, Superintendent of Sewers and Superintendent of Streets shall
be performed by the Director of Public Works. Those of the Super-
intendent of Special Assessments and Chief Clerk of Special Assess-
ments shall be performed by the Director of Finance; those of the
City Engineer or Public Engineer shall be performed by the Director
of Public Works, unless otherwise provided by ordinance."
Section 3. That this ordinance shall be in full force and effect from
and after its passage in the manner provided by law.
