AN ORDINANCE
ESTABLISHING FEES FOR THE CONNECTION AND USE OF THE
BODE ROAD--PARKWOOD EAST UNIT 2 WATERMAIN IMPROVEMENT
WHEREAS, the City of Elgin has caused certain watermain improvements
to be made and identified as the Bode Road--Parkwood East Unit 2 Watermain
Extension; and
WHEREAS, the following improvement has been made:
A twelve inch (12") ductile iron watermain, complete with gate valves,
vaults, hydrants and all cast iron fittings constructed within the public
streets, described as follows:
A twelve inch (12") watermain, from and connected with an existing
twelve inch (12") watermain, at a point approximately six hundred and
sixty feet (660') East of the centerline of Stonehurst Drive on Bode Road.
Thence in an Easterly direction for a distance of nine hundred and
ninety-seven point seventy-five feet (997.75') parallel with the center
line of Bode Road, at a distance of approximately thirty-five feet (35')
north of the center line of Bode Road to the Easterly line of Parkwood
East Unit No. 2.
WHEREAS, the cost to the developer, U.S. Shelter, Inc. to be reimbursed
amounted to $5,241.19; and
WHEREAS, said improvement extends across abutting property located
adjacent to the City of Elgin for a distance of 997.75 lineal feet; and
WHEREAS, the City of Elgin is a home rule unit empowered to exercise
any power or perform any function pertaining to its government and affairs;
and
WHEREAS, it is reasonable to require owners of property abutting or
adjoining said improvement to bear a proportionate share of the cost of
said improvement in the event that said owners desire to connect to and use
said watermains.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS:
Section 1. That any owner of property adjoining the above described
Bode Road--Parkwood East Unit 2 Watermain Extension who desires to connect
to and use said facilities shall pay to the City Treasurer of the City of
Elgin, Illinois, a fee in an amount determined according to the front
footage of property in relation to the total front footage of adjoining
property. Said fee shall be in addition to any and all fees established by
the City of Elgin for water service.
t""'' Section 2. That in accordance with the provisions of this ordinance
the following amounts are established and required to be paid for connection
to the Bode Road--Parkwood East Unit 2 Watermain Extension by property adjoin-
ing said improvement.
Section 3. That the aforesaid amounts have been determined in accordance
with Exhibit A-1 which is attached hereto and made a part hereof by reference.
Section 4. That any property held in common ownership with other
property subject to the provisions of this ordinance on the effective day
of this ordinance shall be subject to payment based on the entire amount esta-
blished for the entire parcel as provided in Section 2 of this ordinance.
Section 5. That any person desiring to connect to the aforesaid water-
main improvements may pay said amount in full without interest if payment is
made prior to September 30, 1980 and that if said full payment is not made by
September 30, 1980 then payment shall be made in full plus interest at the
rate of 7% per annum accruing from and after October 1, 1980 to the date
of payment.
Section 6. That any amounts received by the City Treasurer for connection
and use of the above described watermain by properties described under Sec-
tion 2 shall be paid to U.S. Shelter, Inc. or their successors or assigns,
as reimbursement for the cost and expense of extending said watermain.
Section 7. That a certified copy of this ordinance shall be recorded
with the Recorder of Deeds of Cook County, Illinois.
Section 8. That all ordinances or parts of ordinances in conflict with
the provisions of this ordinance be and are hereby repealed.
Section 9. That this ordinance shall be in full force and effect from
and after its passage and approval in the manner provided by law and shall be
published in pamphlet form by authority of the City Council.
