eow AN ORDINANCE
CLASSIFYING CERTAIN NEWLY ANNEXED TERRITORY AND GRANTING A
SPECIAL USE FOR A PLANNED UNIT DEVELOPMENT
(Located at the Southeast Corner of Randall Road and South Street)
WHEREAS, the territory herein described has heretofore been annexed
to the City of Elgin pursuant to the terms of an annexation agreement
between the City of Elgin and the owners of record of said territory; and
WHEREAS, the annexation agreement concerning said territory provides
that the City of Elgin shall proceed to classify the territory in accordance
with its terms; and
WHEREAS, all required public hearings have been conducted and all
notices required to be given by law have been given; and
WHEREAS, the Land Use Committee has submitted its written findings and
recommended that the proposal for a planned unit development as a special
use in a B-3 Service Business District be denied; and
WHEREAS, the corporate authorities have reviewed the findings of fact
and recommendation of the Land Use Committee and transcript of the public
hearing and find and determine that the proposed special use for a planned
unit development in a B-3 Service Business District be granted.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
eft ILLINOIS:
Section 1. That Chapter 19.08, Section 19.08.020, entitled "Zoning
District Map" of the Elgin Municipal Code, 1976, as amended, be and the
same is hereby further amended by adding thereto the following paragraph:
"The boundaries hereinbefore laid out in the 'Zoning
District Map' , as amended, be and are hereby altered by
including in B-3, Service Business District, the following
described property:
The North 700.00 feet (as measured at right angles to the
North line thereof) of the following described property: That
part of the Southwest Quarter of the Northwest Quarter of Sec-
tion 21, Township 41 North, Range 8 East of the Third Principal
Meridian lying Easterly of the Easterly right of way line of
Randall Road (Except that part falling within the right of way
of South Street), containing 11.796 Acres more or less and being
situated in the Township of Elgin, Kane County, Illinois."
Section 2. That the City Council of the City of Elgin, Illinois, hereby
finds and determines that the development of the territory heretofore described
as a planned unit development substantially as depicted on the site plan pre-
pared by Burnidge, Cassell and Associates, dated June 27, 1980 and revised
July 17, 1980, which is attached hereto and made a part hereof by reference
as Exhibit A, is necessary for the, public convenience at the location proposed
in providing a retail department store on the western limits of the City of
Elgin for the benefit of residents of the surrounding area and to serve
anticipated growth and development in the future and will create needed
employment opportunities;
That the City Council of the City of Elgin, Illinois, further finds that
such planned unit development is so designed, located and proposed to be
operated that the public health, safety and welfare will be protected for the
reasons said development will be completed substantially in accordance with
the subdivision ordinance and zoning ordinance; access to Randall Road will
be prohibited, adequate setbacks will be provided, the service dock will be
screened, and free standing signs will be prohibited;
That the City Council of the City of Elgin, Illinois, further finds
that such planned unit development will not cause substantial injury to
surrounding property, as it is consistent with the comprehensive plan for
the unincorporated area and adjacent to a proposed commercial development
and is so designed androcated to minimize impact and effect on residential
uses in the surrounding area.
Section 3. That a special use for a planned unit development on the
parcel heretofore described be and is hereby granted on the condition that
such special use will be substantially in accordance with the site plan
prepared by Burnidge, Cassell and Associates, dated June 27, 1980 and revised
July 27, 1980, and in accordance with the provisions of the annexation agree-
ment entered into by the City of Elgin and the owners of record of the
subject territory on or about August 28, 1980.
Section 4. That this ordinance shall be in full force and effect from
and after its passage in the manner provided by law.
