GRANTING A SPECIAL USE FOR A CHURCH AT 12 SOUTH CHAPEL STREET
WHEREAS, written application has been made for a special use for
a church at the property commonly known as 12 South Chapel Street,
Elgin, Illinois; and
WHEREAS, after due notice as required by law the Elgin Land Use
Committee conducted a public hearing and recommended that the special
use requested be granted; and
WHEREAS, the City Council of the City of Elgin concurs in the
recommendations of the Land Use Committee.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That the City Council hereby finds and determines that
the proposed special use is deemed necessary for the public convenience
at that location in providing a place of worship for approximately 75
members of the proposed church.
Section 2. That the City Council of the City of Elgin further finds
and determines that the proposed special use is so designed, located and
proposed to be operated that the public health, safety and welfare will
be protected and that the principle use of the premises will be on Sunday
mornings at such time as surrounding commercial activity is limited and
adequate off-street parking is available.
Section 3. That the City Council of the City of Elgin further finds
and determines that the proposed special use will not cause substantial
injury to the value of other property in the neighborhood in which it is
located because the premises were constructed and designed for use as a
church, the subject property is located in a transitional zone with mixed
uses and the use of the premises will be confined to Sunday mornings.
Section 4. That a special use be and is hereby granted to the St.
Paul Baptist Church for the use of the premises at 12 South Chapel Street,
Elgin, Illinois, as a church; that the legal description of the subject
property is as follows:
The Southerly 49.5 feet of Lot 1 and the Southerly 49.5
feet of the Easterly 32 feet, and Southerly 8.25 feet of the
Westerly 24 feet of Lot 2 of Block 1 of Gifford's Plat in the
City of Elgin, Kane County, Illinois.
Section 5. That this ordinance shall be in full force and effect
from and after its passage in the manner provided by law.
