HomeMy WebLinkAboutG27-80 Ordinance No. G27-80 AN ORDINANCE RECLASSIFYING CERTAIN PROPERTY LOCATED AT 726 EAST CHICAGO STREET, AND GRANTING A SPECIAL USE FOR A STORAGE YARD WHEREAS, written application has been made to reclassify the premises located at 726 East Chicago Street, from B-3, Service Business District, to B-4, General Service District, and for a special use for a storage yard; and WHEREAS, the Land Use Committee conducted a public hearing after due notice as required by law and has recommended the granting of the requested reclassification and special use subject to certain conditions; and WHEREAS, the City Council of the City of Elgin, Illinois, concurs in the recommendations of the Land Use Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the City Council of the City of Elgin, Illinois, hereby finds and determines that the requested special use for a storage yard is necessary for the public convenience in providing a necessary storage area to serve the principle use of the premises as a rental service. Section 2. That the City Council of the City of Elgin, Illinois, further finds and determines that the proposed storage yard is so designed, located and proposed to be operated that the public health, safety and welfare will be protected by conformance to the site development plan, the prohibition of testing of rental equipment on the subject property and the direction of lighting so as not to interfere with adjacent property. Section 3. That the City Council of the City of Elgin, Illinois, further finds and determines that the proposed storage yard will not cause substantial injury to the value of other property in the neighborhood in which it is located as the surrounding area is predominately used for commercial purposes and is zoned for such purposes. Section 4. That Section 19.08.020 of Chapter 19.08 entitled "Zoning District Map" of the Elgin Municipal Code, 1976, as amended, be and the same is hereby further amended by adding thereto the following paragraph: "The boundaries hereinbefore laid out in the 'Zoning District Map' , as amended, be and are hereby altered by exclud- ing from B-3, Service Business District, and including in B-4, General Service District, the following described property: That part of Lot 16 in County Clerk's Subdivision of the Southwest Quarter of Section 18, Township 41 North, Range 9, East of the Third Principal Meridian, located in the City of Elgin, described as follows: Commencing at the North West corner of the South West Quarter of Section 18 and running thence South along the West line of said Section 266 feet to the Northerly line of Chicago Street extended; thence East along the Northerly line of Chicago Street and said Northerly line extended a distance of 568.3 feet to a place of beginning; thence Easterly along the Northerly line of Chicago Street 100 feet; thence Northerly at right angles to the Northerly line of Chicago Street 150.0 feet; thence Westerly parallel with the Northerly line of Chicago Street 193.7 feet to the Easterly bank of a creek; thence Southerly and South Easterly along the East- erly bank of said creek to the place of beginning, in the City of Elgin, Cook County, Illinois." Section 5. That a special use for a storage yard on the above described premises is hereby granted subject to the following conditions: a. That the storage yard shall be developed and maintained substantially in accordance with the site plan attached hereto and made a part hereof as Exhibit A. b. That rental equipment shall not be tested on the subject property. c. That a plat of easement along Willow Creek shall be executed and filed with the City Clerk. Section 6. That this ordinance shall be in full force and effect from and after its passage in the manner provided by law and shall be published in pamphlet form by authority of the City Council. s! Richard L.
