HomeMy WebLinkAboutG26-80Ordinance No. G26 -80 AN ORDINANCE RECLASSIFYING PROPERTY AND GRANTING A SPECIAL USE FOR A PLANNED UNIT DEVELOPMENT AND A VARIATION FROM THE OFF- STREET PARKING REQUIREMENTS FOR PROPERTY LOCATED AT 260 CENTER STREET WHEREAS, written application has been made for reclassification from B -1, Community Business District, to R -4, General Residence District, and a special use for a planned unit development and a variation from the off - street parking requirements to permit the conversion of a vacant school building located at 260 Center Street to a multi - family residential structure; and WHEREAS, after due notice in the manner required by law the Land Use Committee conducted a public hearing on the application; and WHEREAS, the Land Use Committee has recommended that the application be granted subject to certain conditions; and WHEREAS, the City Council of the City of Elgin concurs in the recommenda- tions of the Land Use Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the City Council of the City of Elgin hereby finds and determines that the recommended special use is necessary for the public con- venience at the proposed location in providing needed units for low and moderate income housing and to return the structure located on the premises to active use. Section 2. That the City Council of the City of Elgin further finds and determines that the special use requested is so designed, located and proposed to be operated that the public health, safety and welfare will be protected in that the requested special use will result in the conversion of an institutional building into a residential structure compatible with the surrounding neighborhood. Section 3. That the City Council of the City of Elgin further finds and determines that the proposed special use will not cause substantial injury to the value of other property in the neighborhood in which it is located in that the subject property is located in a neighborhood which is essentially residential in character of a relatively high density nature. Section 4. That the City Council of the City of Elgin further finds and determines that the conversion of the existing school building to a residential structure is not economically feasible if less than 27 units are permitted. Section 5. That the City Council of the City of Elgin further finds and determines that anticipated parking demand will be substantially less than as provided for by the zoning ordinance and that a variation to reduce the number of required parking spaces to one per dwelling unit should be granted. Section 6. That Section 19.08.020 of Chapter 19.08 entitled "Zoning District Map" of the Elgin Municipal Code, 1976, as amended,be and the same is hereby further amended by adding thereto the following paragraph: "The boundaries hereinbefore laid out in the 'Zoning District Map', as amended, be and are hereby altered by excluding from B -1, Community Business District, and including in R -4, General Residence District, the following described property: Lots 37, 38 and 39 in P. J. Kimball, Jr. Is 2nd Addition to Elgin, in the City of Elgin, Kane County, Illinois AND ALSO Lot 8 and the Easterly 33 feet of Lot 1 in Block 2, P. J. Kimball's 3rd Addition to Elgin, in the City of Elgin, Kane County, Illinois." Section 7. That a special use be and is hereby granted for a multiple family residence on the above described property, commonly known as 260 Center Street, Elgin, Illinois, substantially as shown on Exhibit A, attached hereto and made a part hereof by reference. Section 8. That a variation from the off - street parking requirements of the Elgin Zoning Ordinance as apply to the special use for a planned unit development granted herein is hereby granted to reduce the number of required parking spaces to one space per dwelling unit, subject to the following condi- tions: a. Not later than one year after full occupancy of the structure has been achieved, the developer shall obtain at his expense a current parking study showing the level of demand for the fully occupied structure. b. That within 10 days following passage of this ordinance, developer shall file a written agreement to provide adequate off - street parking spaces in the event that the parking study made after full occupancy indicates that the demand of one parking space per dwelling unit is not sufficient to meet demand. c. Additional parking shall be provided within one year following completion of the parking study following full occupancy of the structure. Section 9. That this ordinance shall be in full force and effect from and after its passage in the manner provided by law and shall be published in pamphlet form by authority of the City Council. s/ Richard L.
