HomeMy WebLinkAboutG51-79 Ordinance No. G51-79 AN ORDINANCE AMENDING THE ELGIN ZONING ORDINANCE TO PROVIDE FOR TEMPORARY MINING AS A SPECIAL USE WHEREAS, a written petition has been filed to amend the test of the Elgin Zoning Ordinance by providing for temporary mining as a special use; and WHEREAS, a public hearing was held by the Elgin Planning Committee after due notice in the manner provided by law; and WHEREAS, the Elgin Planning Committee has recommended amendment of the Elgin Zoning Ordinance as requested. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Section 19.12.020 of Chapter 19.12 of the Elgin Municipal Code, 1976, as amended, is hereby amended by adding the follow- ing: "P. Temporary mining of topsoil, earth, clay, gravel, peat, sand, and stone when such a mining operation is performed in conjunction with site preparation for public or residential developments. Special use approval is con- tingent upon receipt of acceptable, detailed operation and reclamation plans. Plans shall include the following: 1. The Operational Plan shall include a site plan, the location of buildings and processing equip- ment, the location of access roads, fencing and screening provisions, environmental impact control measures, written:explanation of proposed special use, and other information concerning the proposed use as may be requested by the Department of Community Development of the City of Elgin; and 2. Tho Reclamation Plan is to include a site plan, a development phasing schedule, written explanation and other information as required by the Department of Community Development of the City of Elgin." Section 2. That Section 19.28.030 of Chapter 19.28 of the Elgin Municipal Code, 1976, as amended, is hereby amended by adding the follow- ing: "14. Temporary mining of topsoil, earth, clay, gravel, peat, sand, and stone when such a mining operation is performed in conjunction with site preparation for public or commercial developments. Special use approval is con- tingent upon receipt of acceptable, detailed operation and reclamation plans. These plans are to include the following: 1. The Operational Plan is to include a site plan, the location of buildings and processing equipment, the location of access roads, fencing and screening pro- visions, environmental impact control measures, written explanation of the proposed special use, and other information as required by the Department of ; Community Development of the City of Elgin. 2. The Reclamation Plan is to include a site plan, a development phasing schedule, written explanation of the proposed special use, and other information as required by the Department of Community Develop- ment of the City of Elgin." Section 3. That Section 19:38.020 of Chapter 19.38 of the Elgin Municipal Code, 1976, as amended, is hereby amended by adding the follow- ing: "10. Temporary mining of topsoil, earth, clay, gravel, peat, sand, and stone when such a mining operation is performed in conjunction with site preparation for public or industrial developments. Special use approval is con- tingent upon receipt of acceptable, detailed operation and reclamation plans. These plans are to include the follow- ing: 1. The Operational Plan is to include a site plan, the location of buildings and processing equipment, the All location of access roads, fencing and screening pro- visions, environmental impact control measures, written explanation of the proposed special use, and other information as required by the Department of Community Development of the City of Elgin. 2. The Reclamation Plan is to include a site plan, a development phasing schedule, written explanation of the proposed special use, and other information as required by the Department of Community Develop- ment of the City of Elgin." Section 4. That this ordinance shall be in full force and effect ten days after its passage and publication in pamphlet form as authorized by the City Council of the City of Elgin. s/ Richard L.
