HomeMy WebLinkAboutG44-79 Ordinance No. G44-79 AN ORDINANCE AMENDING CHAPTER 9.24 ENTITLED, "GARBAGE AND REFUSE" BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Chapter 9.24 of the Elgin Municipal Code, as amended, is hereby amended to read as follows: "9.24.010 Containers required - Use. A. It shall be the duty of every owner, tenant, lessee or occupant of all premises to at all times maintain in good order and repair a container or containers for the deposit of garbage, tin cans, bottles and similar refuse. B. It shall be the duty of every owner, tenant, lessee or occupant to deposit all garbage and refuse in required con- tainers. 9.24.020 Garbage containers - Specifications. A. Garbage containers shall be watertight and made of either metal with suitable handles for carrying and close- fitting covers or heavy gage plastic bags of at least one and r one half millimeters in thickness when securely tied and when the contents will not cause the bag to tear. B. Garbage containers shall have a capacity of not more than forty-five gallons and the weight of the container and its contents shall not exceed fifty pounds in weight. 9.24.030 Garbage deposited in the street prohibited. A. No garbage or refuse of any kind shall be deposited in any street, alley or public place, except as provided in this chapter. B. Garbage containers may be placed on the tree bank or parkway adjoining the public street or alley not more than 24 hours prior to its scheduled collection and shall be so placed that its contents will not be blown about or scattered by natural elements. A collection schedule shall be established by the Director of Public Works and posted in the office of the City Clerk for public inspection. 9.24.040 Penalty. In addition to any other penalty provided by law, the Director of Public Works is authorized to refuse collection services until such time as all requirements of this chapter are met."
