REGULATING THE BURNING OR DISPOSAL OF LEAVES
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS:
Section 1. That Section 9.28.130 of Chapter 9.28 of the Elgin Municipal
Code, 1976, as amended, be and is hereby amended to read as follows:
"9.28.130 Open fires.
(1) It is unlawful for any person to cause, suffer, allow
or permit open burning of rubbish, refuse of any kind, grass,
wood, garbage, metal salvage, or any other material in open
fires provided however, that it is not unlawful for an owner
of residential property to burn or permit to be burned such sub-
stances as are reasonably necessary for the purpose of cooking
food for consumption by his family and guests.
(2) The city council may, however, authorize upon specific
request, controlled burning on a limited basis, for school,
governmental or other institutional functions, provided that
the council finds that such burning will pose no danger, or
inconvenience to adjoining property owners and will not be
detrimental to the general public health and safety of the
eft community.
(3) Open burning of leaves shall be permitted only during
the times and under the conditions otherwise provided by ordinance.
It shall be unlawful to cause, allow or permit the open burning of
leaves except as provided by ordinance."
Section 2. That Section 9.28.135 is hereby added to Chapter 9.28 of the
Elgin Municipal Code, 1976, as amended, to read as follows:
"9.28.135 Open burning of leaves.
(1) The burning of leaves be and is hereby permitted within the
corporate boundaries of the City of Elgin during the months of April,
October and November on private property.
(2) No fire for the purpose of burning leaves shall be initiated
before 7:30 a.m. or after 3:00 p.m. All such fires shall be extinguished
prior to 6:00 p.m.
(3) No leaf fire shall be permitted on public property including
parkways, sidewalks, treebanks, driveway approaches or in streets
except in areas designated for such purposes by or on behalf of the
City of Elgin.
(4) No leaf fire shall be left unattended."
Section 3. That Section 9.24.045 be and is hereby added to Chapter 9.24
of the Elgin Municipal Code, 1976, as amended, to read as follows:

9.24.045 Disposal of leaves.
Any person desiring to dispose of leaves through municipal
collection services shall deposit said leaves in a suitable
plastic bag securely tied and deposited for collection on
garbage and refuse pick-up days."
Section 4. That this ordinance shall be in full force and effect ten
days after its publication in pamphlet form by authority of the City Council.
