HomeMy WebLinkAboutG26-79 Ordinance No. G26-79 AN ORDINANCE GRANTING A SPECIAL USE FOR A RADIO TRANSMISSION TOWER AT 1010 BLUFF CITY BOULEVARD WHEREAS, written application has been made to erect and maintain a radio transmission tower on the premises commonly known as 1010 Bluff City Boulevard; and WHEREAS, the Land Use Committee conducted a public hearing after due notice as required by law; and WHEREAS, the Land Use Committee has recommended that a special use be granted; and WHEREAS, no objection has been made to the proposed special use; and WHEREAS, the City Council concurs in the recommendation of the Land Use Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the City Council hereby finds that the proposed special use is necessary for the public convenience in providing a transmission source for the provision of radio repeater and pager services in and around the City of Elgin. Section 2. That the special use proposed will consist of the erection and maintenance of a radio transmission tower not to exceed 190 feet in height in a manufacturing zone and in accordance with state and federal statutes and is so designed, located and proposed to be operated that the public health, safety and welfare will be protected. Section 3. That the City Council finds that the proposed special use is surrounded by a public highway to the north, a cemetery to the south and manufacturing uses to the east and west and therefore will not cause sub- stantial injury to the value of the surrounding property. Section 4. That a special use be and is hereby granted for the erection and maintenance of a radio transmission tower on the premises legally described as follows: The Easterly 24.25 feet of Lots 11 and 35 and the Westerly 24.25 feet of Lots 10 and 36 of Block 5 of Mason's Addition of the Southeast Quarter of Section 19 in the City of Elgin, Cook County, Illinois. subject to the following conditions: a. The radio transmission tower shall not exceed 190 feet in height; b. The radio transmission tower shall be erected within twelve months from the date of the passage of this ordinance; c. That the radio transmission tower authorized herein shall be kept in a state of good maintenance and repair; All d. That any radio transmission tower erected on the premises shall be removed within thirty days following discontinuance of use; e. That the special use granted herein shall expire upon abandonment for more than 180 days or violation of any of the conditions imposed; f. That the applicant shall file his written acceptance of the special use granted and conditions imposed. Section 5. That this ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law. s/Richard L. Verbic Richard L.
