AN ORDINANCE
GRANTING A SPECIAL USE FOR A DAIRY PROCESSING PLANT
WHEREAS, written application has been made for a special use permit to
expand the existing dairy processing plant located at 219 Douglas Avenue,
Elgin, Illinois; and
WHEREAS, the Land Use Committee conducted a public hearing on said
application following due notice in the manner required by law; and
WHEREAS, the Land Use Committee recommended approval of the application
subject to certain conditions; and
WHEREAS, the City Council concurs in the recommendation of the Land Use
Committee.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That the City Council hereby finds and determines that the
proposal special use for the expansion of the dairy processing plant at
219 Douglas Avenue, Elgin, Illinois, is necessary for the public convenience
to provide necessary and ordinary expansion of the existing dairy processing
plant;
That the City Council further finds that the proposed special use is
so designed, located and proposed to be operated that the public health,
safety and welfare will be protected in that the expansion of the dairy
processing plant will provide employees off-street parking and promote
traffic safety by permitting truck traffic to enter without extended street
maneuvers;
That the City Council further finds that the proposed special use is
compatible with surrounding uses as the surrounding uses are primarily
commercial and the proposed special use will not cause substantial injury
to the value of other property in the neighborhood in which it is located
but on the contrary will increase said values by improving the traffic
system and will represent a continuation of the existing compatible use.
Section 2. That a special use be and is hereby granted to the Ludwig
Dairy Corporation for the construction of a 1500 square foot building to
serve the existing dairy processing plant on the following described premises:
The North 108 feet of the West 164 feet of Reserved Lot
Number 47 of Phineas J. Kimball Jr°s. Second Addition to Elgin,
in the City of Elgin, Kane County, Illinois AND ALSO that part
of the South half of the vacated alley lying Northerly of and
adjacent to the North line and lying between the East and West
lines extended Northerly of the aforedescribed property, in the
City of Elgin, Kane County, Illinois.
subject to the condition that the building addition will be used for the
manufacture of plastic milk bottles solely for bottling of milk on the
premises of Ludwig Dairy Corporation.
Section 3. That this ordinance shall be in full force and effect from
and after its passage in the manner provided by law.
