HomeMy WebLinkAboutG81-78 1 Ordinance No, G81-78 AN ORDINANCE CLASSIFYING CERTAIN NEWLY ANNEXED TERRITORY TO THE CITY OF ELGIN AND GRANTING A SPECIAL USE FOR A PLANNED UNIT DEVELOPMENT WHEREAS, the City of Elgin, a municipal corporation, and the owners of record of certain territory hereinafter described, have entered into a certain annexation agreement for the annexation of said territory and development of said territory as a planned unit development; and WHEREAS, prior to the execution of the aforesaid annexation agreement public hearings were held as required by law, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS° Section 1. That Chapter 19.08, Section 19°08,020, entitled "Zoning District Map" of the Elgin Municipal Code, 1976, as amended, be and the same is hereby further amended by adding thereto the following paragraph: "The boundaries hereinbefore laid out in the 'Zoning District Map° , as amended, be and are hereby altered by including in R-2, Single-Family Residence District, the following described property: That part of Sections 19 and 20, Township 41 North, Range 9 East of the Third Principal Meridian described as follows: Commencing at the Northeast corner of said Section 19; thence South 00° 33° 599" West along the East line of said Section 19 for a distance of 59839 feet; thence South 63° 54° 45" West for a distance of 200000 feet; thence South 01° 28' 42" West for a distance of 1268,36 feet to the point on the South line of School District U-46, said point also being the point of beginning; thence Easterly along a curve having a radius of 600 feet concave Northerly, for a distance of 163°59 feet; thence South 14° 20° 22" East for a distance of 153,32 feet; thence South 000 East for a distance of 350.00 feet; thence South 33° 03° 42" East for a distance of 498,65 feet; thence South 04° 46° 29" East for a distance of 100,00 feet; thence South 25° 13' 31" West for a distance of 115.00 feet; thence North 84° 46' 29" West for a distance of 50,00 feet; thence South 25° 13' 31" West for a distance of 155,00 feet; thence Northwesterly along a curve, concave Southwesterly, having a radius of 824°25 feet, for a distance of 539,58 feet; thence South 810 42' 50" West for a distance of 270000 feet; thence North 08° 17' 10" West for a distance of 160°00 feet; thence South 81° 42° 50" West for a distance of 295.00 feet; thence North 53° 00' 29" West for a distance of 404,66 feet; thence North 34 27' 11" East for a distance of 375,00 feet; thence North 55° 32° 49" West for a distance of 160,00 feet; thence North 34° 27' 11" East for a distance of 240°00 feet; thence South 55° 32° 49" East for a distance of 160°00 feet; thence North 44° 27' 11" for a distance of 110.00 feet; thence North 18° 13' 20" East for a distance of 141,09 feet; thence North 00° East for a distance of 125.00 feet to a point on the South line of said U-46 School District; thence South 88° 43' 04" East along said South line of f U-46 School District for a distance of 643.83 feet to the point on beginning, in Cook County, Illinois, containing 31.2 Acres more or less." Section 3. That Chapter 19.08, Section 19.08.020, entitled "Zoning District Map" of the Elgin Municipal Code, 1976, as amended, be and the same is hereby further amended by adding thereto the following paragraph: "The boundaries hereinbefore laid out in the 'Zoning District Map° , as amended, be and are hereby altered by including in B-1, Community Business District, the follow- ing described property: That part of Section 19, Township 41 North, Range 9 East of the Third Principal Meridian described as follows: Commencing at the Northeast corner of said Section 19; thence South 00° 33° 59" West along the East line of said Section 19 for a distance of 598.39 feet; thence South 63° 54° 45" West for a distance of 200.00 feet; thence South 01° 28' 42" West for a distance of 1268.36 feet to the South line of School District U-46; thence North 88° 43' 03" West along said South line of School District U-46 for a distance of 1873.83 feet to a point on the East line of Lot 4 of County Clerk's Division of Unsubdivided land in Section 19, said point also being the point of beginning; thence South 10° 04' 53" West along the East line of said Lot 4 for a distance of 680.07 feet to a point on the Northerly right-of-way of U.S. Route 20; thence South 56° 01° 18" East along said Northerly right-of-way for a distance of 500.00 feet; thence North 340 27' 11" East for a distance of 1006.14 feet; thence North 00° East for a distance of 100.00 feet to the South line of said U-46 School District, thence North 88° 43' 03" West along the South line of said U-46 School District for a distance of 865.00 feet to the point of beginning in Cook County, Illinois, containing 13.6 Acres more or less." F Section 4. That the City Council of the City of Elgin, Illinois, hereby finds and determines that the development of the territory hereto- fore described as a planned unit development substantially as depicted on a preliminary plan prepared by Win. A. Dean, dated June 27, 1978 and revised August 31, 1978, which is attached hereto and made a part hereof by reference r as Exhibit A, is necessary for the public convenience at the location proposed by providing single family dwellings in an area designated and intended for such uses support by limited commercial uses; That the City Council of the City of Elgin, Illinois, ftirther finds that such planned unit development is so designed, located and proposed to be operated that the public health, safety and welfare will be protected and that said development will be complted substantially in accordance with the subdivision ordinance and zoning ordinance; That the City Council of the City of Elgin, Illinois, further finds that such planned unit development is substantially similar to surrounding land uses and is composed principally of single family dwellings similar to those in the surrounding neighborhood and will not cause substantial injury to surrounding property. Section 5. That a special use for a planned unit development on the parcels heretofore described be and is hereby granted on the condition that such special use will be substantially in accordance with the plan of development prepared by Wm. A. Dean, dated June 27, 1978 and revised August 31, 1978, and in accordance with the provisions of the annexation agreement entered into by the City of Elgin and the owners of record of the subject territory on or about November 14, 1978.
