AN ORDINANCE
AUTHORIZING THE ACQUISITION OF CERTAIN PROPERTY FOR MUNICIPAL PURPOSES
WHEREAS, the City Council of the City of Elgin has determined that
it is necessary and desirable to construct a water treatment plant; and
WHEREAS, in order to construct such water treatment plant it is
necessary to acquire certain property, hereinafter legally described, for
municipal purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That it is hereby determined that a water treatment plant
be constructed and maintained in the City of Elgin, Kane County, Illinois,
and that certain property, hereinafter described, be acquired for such
purposes.
Section 2. That it is hereby determined that it is necessary and
desirable that the City of Elgin shall acquire title to and possession
of the following described real property, which property is necessary,
required and needed for the purpose of constructing and maintaining a
public water treatment plant and incidental surrounding ground, lying
wholly within the limits of the City of Elgin, to-wit:
That part of the East Half of Fractional Section 2, Township 41
North, Range 8 East of the Third Principal Meridian, described as
follows: Beginning at the Southeast corner of Lot 24 in Riverside
Manor Unit No. 2, being a Resubdivision of Lot 17 in Riverside Manor
Unit No. 1 and part of Fractional Section 2, Township 41 North,
Range 8 East of the Third Principal Meridian; thence Easterly along
the Northerly line extended Easterly of Ranch Road as platted in
said Riverside Manor Unit No. 2, a distance of 721.59 feet to a line
drawn parallel with and 537.23 feet West of (as measured along the
Southerly line of a tract of land conveyed to Northern Illinois Gas
Company by Deed dated November 21, 1958 and recorded November 28,
1958 in Book 1932, Page 239, as Document No. 876705) the East line
of the Southeast Quarter of said Fractional Section 2; thence
Southerly along said parallel line, a distance of 414.01 feet;
thence South 89 degrees 34 minutes West, a distance of 584.64 feet
to a point on the Easterly line of Lot 46 in said Riverside Manor
Unit No, 2, that is 3.03 feet Northerly of (as measured along said
Easterly line) the Southeast corner of said Lot 46; thence Northerly
along the Easterly line of Lots 46 and 47 in said Riverside Manor
Unit No. 2, a distance of 233.07 feet to the Southeasterly corner
of Lot 48 in said Riverside Manor Unit No. 2; thence Northerly
along the Easterly line of said Lot 48, a distance of 115.15 feet
to the Northeasterly corner of said Lot 48; thence Westerly along
the Northerly line of said Lot 48, a distance of 175.0 feet to the
Southeasterly corner of Ranch Road as platted in said Riverside
Manor Unit No. 2; thence Northerly along the Easterly end of Ranch
Road as platted in said Riverside Manor Unit No. 2, a distance of
67.31 feet to the point of beginning, in the City of Elgin, Kane
County, Illinois.
Section 3. That Leo I. Nelson, City Manager.of the City of Elgin, be
and is hereby authorized, empowered and directed to negotiate for and on
behalf of the City of Elgin with the owner or owners of the above described
real property for the purchase thereof by the City of Elgin.
Section 4. That the City Manager be and is hereby authorized to offer
the sum of $136,000 as and for compensation to the owner or owners of the
above described property; said offer shall be in writing.
Section 5. In the event that the City Manager is unable to agree with
the owner or owners of said property as to compensation to be paid therefor,
in accordance with the provisions of this ordinance, then title to and
possession of said property shall be acquired by the City of Elgin in
accordance with the laws of eminent domain of the State of Illinois, and
the Corporation Counsel is hereby authorized, empowered and directed to
institute approriate proceedings in any court of competent jurisdiction
to acquire title to and possession of said property for the City of Elgin
in accordance with- the eminent domain laws of the State of Illinois.
Section 6. That this ordinance take effect and be in full force from
and after its passage.
