r AN ORDINANCE
RECLASSIFYING CERTAIN PROPERTY AT 510 WEST HIGHLAND AVENUE
FROM B=3 and R=4 TO R-4 WITH A SPECIAL USE FOR A
GROUP HOME FOR CHILDREN
WHEREAS, written application has been made for the reclassifying of
certain property located in the City of Elgin and commonly known as
510 West Highland Avenue, Elgin, Illinois, from B-3, Service Business
District, and R-4, General Residence District, to R-4, General Residence
District, with a special use for a group home for children; and
WHEREAS, the Land Use Committee conducted a public hearing on said
application following due notice as required by law; and
WHEREAS, the Land Use Committee has recommended approval of the
application subject to certain conditions; and
WHEREAS, the City Council of the City of Elgin concurs in the
recommendations of the Land Use Committee.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1, That Section 19°08°020 of Chapter 19008 of Title 19 of
the Elgin Municipal Code, 1976, as amended, be and the same is hereby
!e" further amended by adding thereto the following paragraph:
"The boundaries hereinbefore laid out in the 'Zoning
District Map' , as amended, be and are hereby altered by
excluding from B-3, Service Business District, and R=4,
General Residence District, and including in R-4, General
Residence District, the following described property:
Lot 4 and the Easterly 6 feet of Lot 3 in Block 54 of
W. C. Kimball's Second Addition to Elgin and the Westerly
half of Lots 1 and 2 in Block 43 of the Original Town of
Elgin, on the West side of the Fox River, in the City of
Elgin, Kane County, Illinois,"
commonly known as 510 West Highland Avenue, Elgin, Illinois.
Section 2e That the City Council hereby finds that the proposed
special use is necessary for the public convenience at the location
proposed in providing a group home for children;
That the City Council further finds that the proposed special use
is so designed, located and proposed to be operated that the public health,
safety and welfare will be protected by adequate supervision and operation
substantially as a single family dwelling;
That the City Council further finds that the proposed use will not
cause substantial injury to property in the neighborhood in which it is
located, in that a group home for children is compatible with surrounding
uses.
Section 3. That a special use is hereby granted to Larkin Home for
Children to permit a group home for children subject to the following condi-
tions:
1. That the number of children residing at the group home
shall be limited to seven.
2. That the establishment of the group home use comply with
all other applicable city codes and ordinances and state statutes.
3. That the special use of the property be restricted to
use by the Larkin Home for Children and shall terminate upon
discontinuation of the special use herein granted by the members
of the Larkin Home for Children, an Illinois not-for-profit
corporation.
4. That at least three professional staff be present at
the group home during the day and at least one at night.
5. That the existing gravel parking area be paved in
accordance with City standards to accommodate three parking
spaces.
Section 4. That all ordinances or parts of ordinances in conflict
with the provisions of this ordinance are hereby repealed.
Section 5. That this ordinance shall be in full force and effect
from and after its passage in the manner provided by law and shall be
published in pamphlet form by authority of the City Council.
