HomeMy WebLinkAboutG55-78 Ordinance No. G55-78 AN ORDINANCE CLASSIFYING CERTAIN NEWLY ANNEXED TERRITORY WHEREAS, the territory herein described has been annexed to the City of Elgin pursuant to the terms of an annexation agreement between the City of Elgin and the owners of record of said territory; and WHEREAS, the annexation agreement concerning said territory provides that the City of Elgin shall proceed to classify the territory in accordance with its terms; and WHEREAS, all required public hearings have been conducted and all notices required to be given by law have been given. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the City Council finds that the proposed planned unit development_is deemed necessary for the public convenience in providing necessary multiple-family housing; Section 2. That the City Council further finds that the proposed planned unit development is so designed, located and proposed to be operated that the public health, safety and welfare will be protected by limiting building heights and is consistent with existing use of the subject property and anticipated development of adjacent property. Section 3. That the City Council further finds that the proposed planned unit development will not cause substantial injury to surrounding property because said planned development is consistent with anticipated development of unimproved surrounding property. Section 4. That a special use for a residential planned unit develop- ment on the following legally described property: That part of the Northeast quarter of Section 16, Township 41 North, Range 8 East of the Third Principal Meridian, described as follows: Beginning at a point on the North line of said Section 16 that is 1913.57 feet West of the Northeast corner of said Section 16 (said point of beginning being also the Northeasterly corner of a 1.0 acre parcel of land conveyed by William J. and Hima J. Feldman to Samuel W. and Ruth Tonkens) ; thence Southwesterly on the Southeasterly line of the 1.0 acre parcel so conveyed, on a line forming an angle of 62 degrees 29 minutes from West to Southwest with the extension West of the said North line of the section, a distance of 372.77 feet to the center of Highland Avenue Road (also known as S.A. Route No. 47) ; thence Southeasterly on said Highland Avenue Road on a line forming an angle of 90 degrees with the last described line a distance of 204.5 feet; thence Northeasterly on a line forming an angle of 90 degrees (parallel with the said Southeasterly line of the 1.0 acre parcel so conveyed) with the last described course a distance of 479.30 feet to a point on the North line of said Section 16 that is 230.57 feet East of the point of beginning; thence West on said North line 230.57 feet to the point of beginning, containing 2 acres, more or less, in Elgin Township, Kane County, Illinois, except that part thereof lying in the public highway. be and is hereby granted to Philip Wencek, subject to the following condi- tion: 41 No building shall be more than two stories in height. Section 5. That a special use be and is hereby granted for the development of the territory described herein as a planned unit develop- ment upon the express condition that the planned unit development herein granted shall be strictly in accordance with the requirements of the annexation agreement, a copy of which is attached hereto and made a part hereof by reference. Section 6. That this ordinance shall be in full force and effect ten days after its passage and approval and publication in pamphlet form by authority of the City Council. s/ Richard L.
