HomeMy WebLinkAboutG52-78 Ordinance No. G52-78 AN ORDINANCE GRANTING A SPECIAL USE FOR OFF-STREET PARKING AT 653 AND 659 ELMA STREET, ELGIN, ILLINOIS WHEREAS, written application has been made for a special use to permit off-street parking at 653 and 659 Elma Street, Elgin, Illinois; and WHEREAS, the Land Use Committee conducted a public hearing on said application after due notice as required by law; and WHEREAS, the Land Use Committee recommended that the special use requested be granted subject to certain conditions; and WHEREAS, the City Council of the City of Elgin concurs in the recommendations of the Land Use Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the City Council hereby finds that the proposed special use is deemed necessary for the public convenience at that loca- tion to provide necessary off street parking for the adjacent restaurant. The City Council further finds that the proposed use is so designed, located and proposed to be operated that the public health, safety and ft' welfare will be protected by screening the proposed parking lot with a solid fence. The City Council further finds that substantial injury to the value of other property in the neighborhood will not be caused as property to the north and west is classified for commercial uses and the residential zones to the east and west will be protected by a solid fence. Section 2. That a special use is hereby granted to M. Dennis Vander Meer to permit off-street parking on the property commonly known as 653 and 657 Elma Street, Elgin, Illinois, and legally described as follows: Lots 9 and 10 in Block II of Cedarside Addition to Elgin, in the City of Elgin, Kane County, Illinois. subject to the condition that a six foot solid fence shall be erected along the southern and eastern boundaries of the subject property to the building set back line on Elma Street with a three foot solid fence extending there- after to the right of way of Elma Street. Section 3. That this ordinance shall be in full force and effect from and after its passage in the manner provided by law. s/ Richard L. Verbic Richard L.
