HomeMy WebLinkAboutG47-78 Ordinance No. G47-78 AN ORDINANCE CLASSIFYING CERTAIN NEWLY ANNEXED TERRITORY WHEREAS, the territory herein described has been annexed to the City of Elgin pursuant to the terms of an annexation agreement between the City of Elgin and the owners of record of said territory; and WHEREAS, the annexation agreement concerning said territory provides that the City of Elgin shall proceed to classify the territory in accordance with its terms; and WHEREAS, all required public hearings have been conducted and all notices required to be given by law have been given. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the City Council finds that the proposed residential planned unit development is necessary for the public convenience at the location proposed in providing single family dwellings in an area designated and intended for such uses and in the vicinity of existing residential planned unit developments. Section 2. That the City Council further finds that the proposed resi- dential planned unit development is so designed, located and proposed to be elk operated that the public health, safety and welfare will be protected in that said development will be completed substantially in accord with the sub- division ordinance and zoning ordinance. Section 3. That the City Council further finds that the proposed resi- dential planned unit development will not cause substantial injury to surround- ing property as said use will consist of single family dwellings similar to the surrounding neighborhood. Section 4. That a special use for a residential planned unit development on the following legally described property: That portion of the North West Quarter of Section 17, Township 41 North, Range 9 East of the Third Principal Meridian bounded and described as follows: Beginning at the North West (NW) corner of said Section; thence Easterly (E) along the North (N) Section line of said Section, 1177.12 feet; thence Southerly (S) to a point on the South (S) line of the North West Quarter (NW%) of said Section which is 1180.59 feet Easterly (E) of the South West (SW) corner of the North West Quarter (NWl ) of said Section; thence Westerly (W) along the South (S) line of the North West Quarter (NW1 ) of said Section 1180.59 feet to the South West (SW) corner of the North West Quarter (NW14) of said Section; thence Northerly (N) along the West (W) line of the North West Quarter (NW4) of said Section to the point of beginning; excepting a parcel of land in said North West Quarter (NW1 ) , beounded and described as follows: Beginning at a point in the South (S) line of said North West Quarter (NW1 ) that is 997.40 feet East (E) of the South West (SW) corner of said North West Quarter (N1'4) ; thence Easterly (E) along said South (S) line 183.2 feet to the Westerly (W) right-of-way line of a strip of land owned by the Public Service Company of Northern Illinois; thence Northerly (N) along said Westerly (W) right-of-way line 280.0 feet; thence Westerly (W) parallel with the South (S) line of said North West Quarter (NW%) a distance of 183.2 feet; thence Southerly (S) 280.0 feet to the_ place of beginning. Containing 71.850 acres more or less and being situated in Hanover Township, Cook County, Illinois. be and is hereby granted to U.S. Shelter, Inc., subject to the following conditions: 1. Submission and approval of engineering plans and specifications along with the posting of the required performance bond; 2. Compliance with all code and ordinance requirements of the City of Elgin. Section 5. That a special use be and is hereby granted for the develop- ment of the territory described herein as a planned unit development upon the express condition that the planned unit development herein granted shall be strictly in accordance with the requirements of the annexation agreement, a copy of which is attached hereto and made a part hereof by reference. Section 6. That this ordinance shall be in full force and effect ten days after its passage and approval and publication in pamphlet form by authority of the City Council. s/ Richard L.
