AN ORDINANCE
AMENDING AN ORDINANCE REQUIRING THE REPORTING OF TRAFFIC ACCIDENTS
WHEREAS, the Illinois Vehicle Code, Illinois Revised Statutes, 1977,
Chapter 952, Section 11-406, requires the driver of a vehicle which is
involved in an accident resulting in injury or death of any person or in
which damage to property is in excess of $250.00 to make a written report
of such accident; and
WHEREAS, the $250.00 property damage limit was increased from $100.00,
effective October 1, 1977; and
WHEREAS, the City of Elgin has an ordinance requiring an accident report
to the Elgin Police Department whenever the damage is greater than $25.00;
and
WHEREAS, the City of Elgin desires to conform the local property damage
limit with the revised state property damage limit.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS:
Section 1. That Section 11.12.090 of Title 11 of the Elgin Municipal
Code, 1976, be and is hereby amended to read as follows:
"11.12,090 Traffic accident-- Immediate report required when.
The driver of a vehicle involved in an accident resulting in
injury to, or death of, any person, or total damage to all property
to an apparent extent of two hundred fifty dollars or more, shall
immediately, by the quickest means of communication, give notice
of such accident to the police department, if such accident occurs
within this city,"
Section 2. That Section 11.12.100 of Title 11 of the Elgin Municipal
Code, 1976, be and is hereby amended to read as follows
"11.12 ,100 Traffic accident-- Written report required when.
The driver of a vehicle which is in any manner involved in an
accident, resulting in bodily injury to, or death of, any person or
total damage to all property to an apparent extent of two hundred
fifty dollars or more, shall, within five days after such accident,
forward a written report of such accident to the police department.
The provisions of this section shall not be applicable when the
accident has been investigated at the scene by a police officer
while such driver was present thereat."
Section 3. That all ordinances or parts of ordinances in conflict with
the provisions of this ordinance be and are hereby repealed,

Section 4. That this ordinance shall be in full force and effect ten
days after its passage and publication in pamphlet form,
