AMENDING AN ORDINANCE ESTABLISHING A RESIDENTIAL REHABILITATION
GRANT PROGRAM
WHEREAS, the City of Elgin has heretofore established a residential
rehabilitation grant program to encourage the rehabilitation of older
housing units which are in disrepair or deterioration; and
WHEREAS, certain deteriorated housing is rented by individuals who
bear a limited responsibility as to the maintenance and general repair of
such residential structures so as to meet minimum housing code require-
ments; and
WHEREAS, the City of Elgin desires to expand the current residential
rehabilitation grant program in housing units that are non-occupant owned;
and
WHEREAS, the City of Elgin desires to expand the geographical area con-
sidered for residential rehabilitation to include additional areas characterized
by older housing which is or tends to be in a state of disrepair or deteriora-
tion and fails to meet minimum housing code requirements; and
WHEREAS, the City of Elgin is a home rule unit within the meaning of the
Constitution of the State of Illinois and is authorized to exercise any power
and perform any function relating to its government and affairs; and
elk WHEREAS, it is within the government and affairs of the City of Elgin and
in the interest of the public health, safety and welfare to promote the rehabi-
ligation of the deteriorated residential buildings in the City of Elgin.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY C(U4'CIL OF THE CITY OF ELGIN,
ILLINOIS:
Section 1. That Section 3 of Ordinance G42-77 passed on August 10, 1977
be and is hereby amended to read as follows:
"Section 3. Establishment. There is hereby established a
Residential Rehabilitation Grant Program for the City of Elgin.
Owners of residential structures with no more than four (4)
dwelling units are eligible for grants for the renovation and
rehabilitation of such buildings in accordnace with the terms of
this ordinance."
Section 2. That Section 4 of Ordinance G42-77 passed on August 10, 1977
be and is hereby amended to read as follows:
"Section 4. Applicants. Any eprson who is at least 18 years
of age and who has owned a structure eligible for the Residential
Rehabilitation Grant Program defined herein for at least 180 days
prior to making application shall be eligible to apply for a grant
to assist in the cost of rehabilitating or renovating qualifying
residential structures so as to meet minimum housing code require-
ments."
Section 3. That Section 5 of Ordinance G42-77 passed August 10, 1977
be and is hereby amended to read as follows:
"Section 5. A. Grants. The amount of any grant for owner-
occupied dwelling units shall be determined by the Department of
Community Development in accordance with the attached grant
reimbursement chart. The amount of any grant for non-occupant
owners shall be a 15 percent grant; limited to a maximum of $5,000
per dwelling unit. Non-occupant owners shall be limited to two
(2) pending grant applications. No further applications shall be
made until repairs under pending application have been completed.
Partial grants for completed repairs, that are a part of the rehabi-
litation program for that housing unit, may be made if participation
can be shown to be dependent on a staging of the repairs where the
applicant can demonstrate that necessary financing is not obtainable
for complete repairs and that applicant will proceed to make all
necessary repairs in stages or phases approved by the Department of
Community Development.
B. Grants shall be made until funds allocated for such use
are exhausted. For purposes of determining eligibility, income
shall mean the total of the adjusted gross income as defined by the
Internal Revenue Code of the United States and, in addition thereto,
state, municipal and other interest not included in adjusted gross
income, any capital gain deduction and any dividend exclusion, if
not included in adjusted gross income, of all members of the household
of the applicant."
Section 4. That Section 6 of Ordinance G42-77 passed August 10, 1977
be and is hereby amended to read as follows:
"Section 6. Requirements. Any applicant under this ordinance
by making application shall agree to bring the residential structure
which is the subject of the application up to the standards of the
BOCA Code Enforcement Guidelines for Residential Rehabilitation, 1975
Edition, within the period of time approved by the Department of
Community Development. Each applicant shall further agree to own
such rehabilitated and renovated structure for a period not less than
twelve (12) months following receipt of the proceeds of any grant.
Applicants shall execute a written agreement with the City of Elgin
in accordance with the terms of this agreement which shall provide that
failure by the applicant to perform the obligations of the agreement
shall subject the applicant to the repayment of any grant received
plus interest at the rate of seven percent per annum, in addition to
any other penalty which may be provided by law."
Section 5. That Section 11 of Ordinance G42-77 passed August 10, 1977
be and is hereby amended to read as follows:
"Section 11. Eligible Area. Grants under the Residential
Rehabilitation Grant Program of the City of Elgin 'shall be limited
to eligible residential structures located in the following area
within the City of Elgin:
I
Commencing at Jefferson Avenue and Grove Avenue, east on
Jefferson Avenue to Liberty Street, thence south to Franklin,
thence east to Grand Boulevard to the Kane-Cook County line,
thence south to Hammond Avenue, thence west to Grace Street,
thence north to Bluff City Boulevard, thence west to Raymond
Street, thence north to U.S. Route 20, thence west to the Fox
River, thence north to Lake Street, thence west to Wellington,
thence north to Prairie; thence east to Geneva Street, thence
north to Highland Avenue, thence west to Center Street, thence
north to Park Street, thence west to Spring Street, thence north
to Kimball Street, west to Brook Street, north to Seneca Street,
west to Grove Avenue, and north to Jefferson, the place of
beginning, otherwise known as U.S. Census tracts 8513, 8514 and
that portion of 8515 east of the Fox River."
Section 6. That this ordinance shall be in full force and effect from
and after its passage in the manner provided by law.
