HomeMy WebLinkAboutS4-77T Ordinance No. S4-77 AN ORDINANCE ESTABLISHING FEES FOR THE CONNECTION AND USE OF THE SCHROEDER INDUSTRIAL PARK WATER MAIN EXTENSION WHEREAS, the City of Elgin has caused certain water main improvements to be made and identified as the Schroeder Industrial Park Water Main Extension; and WHEREAS, the following improvement has been made:by S.K.S. Enterprises: A twelve inch (12") cast iron water main, complete with gate valves, vaults, hydrants and all cast iron fittings constructed within the Elgin City limits, described as follows: A twelve inch (12") water main, from and connected with an existing twelve inch (12") water main, at a point approximately forty feet (40*) southeast of the intersection of the centerlines of Lovell Road and Sheldon Drive. on Thence southerly for a distance of one thousand six hundred and two feet (1602’) and parallel with and at a distance of fifteen feet (15*) east of the center line of Lovell Road to a point; thence southeasterly for a distance of two hundred twenty feet (220') and parallel with and at a distance of thirty- three feet (33') southwesterly of the northeasterly right-of-way line of Lovell Road to a point; thence easterly for a distance of five hundred fifty and six tenths feet (550.6') and parallel with and fifteen feet (15*) north of the centerline of Lovell Road to a point; thence in an easterly direction nine hundred sixty-nine and four tenths feet (969,4') and northerly of US Route 20 right-of-way to the Elgin Joliet and Eastern Railroad right-of-way; and WHEREAS, the cost of said improvements made. by. S.K.S. Enterprises amounted to $48,256.50; and WHEREAS, said improvement extends across abutting property located within the City of Elgin for a distance of 3342 lineal feet; and WHEREAS, the City of Elgin is a home rule unit empowered to exercise any power or perform any function pertaining to its government and affairs; and WHEREAS, it is reasonable to require owners of property abutting or adjoin­ ing said improvement to bear a proportionate share of the cost of said improve­ ment in the event that said owners desire to connect to and use said water mains. ne.NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That any owner of property adjoining the above described Schroeder Industrial Park Water Main Extension who desires to connect to and use said facilities shall pay to the City Treasurer of the City of Elgin, Illinois, a fee in an amount determined according to the front footage of property in relation to the total front footage of adjoining property. Said fee shall be in addition to any and all fees established by the City of Elgin for water service. Section 2. That in accordance with the provisions of Section 1 of this ordinance the following amounts are established and required to be paid for connection to the Schroeder Industrial Park Water Main Extension by property adjoining said improvement. Section 4, That any property held in common ownership with other property subject to the provisions of this ordinance on the effective day of this ordi­ nance shall be subject to payment based on the entire amount established for the entire parcel as provided in Section 2 of this ordinance. Section 5. That any person desiring to pay for said water main improvement prior to July 1, 1978 may pay said amount in full without interest. Section 6. That any amounts received by the City Treasurer for connection and use of the above described water main for properties other than the parcel described as Parcel III shall be paid to S. K. S. Enterprises or their successors or assigns, as reimbursement for the cost and expense of extending said water main. Section 7.That a certified copy of this ordinance shall be recorded with the Recorder of Deeds of Cook County, Illinois, Section 8. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. Section 9. That this ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law and shall be published in pamphlet form by authority of the City Council.i; S/ Richard L. It involves 39 single family lots and 9 duplex lots. The final plat for Unit 6 conforms with the preliminary plan which you reviewed and approved. It was the staff's recommendation that the final plat be approved subject to : Submission and approval of engineering plans and specifications along with the receipt of a suitable performance bond. (2) Submission of the required minimum school site contribution of $12,304 prior to the issuance of any building permits. (3) Submission of the required minimum park land donation which would be a cash contribution of $13,905. (4) Compliance with all other City of Elgin codes and ordinances.
